20 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS:

22 SECTION 1. REGULAR SALARIES. There is hereby established for the
23 Arkansas Public Employees Retirement System for the 2022-2023 fiscal year,
24 the following maximum number of regular employees.

25 SECTION 2. EXTRA HELP. There is hereby authorized, for the Arkansas
26 Public Employees Retirement System for the 2022-2023 fiscal year, the
27 following maximum number of part-time or temporary employees, to be known as
28 "Extra Help", payable from funds appropriated herein for such purposes: six
29 (6) temporary or part-time employees, when needed, at rates of pay not to
30 exceed those provided in the Uniform Classification and Compensation Act, or
31 its successor, or this act for the appropriate classification.

33 SECTION 3. APPROPRIATION - PUBLIC EMPLOYEES RETIREMENT OPERATIONS.
34 There is hereby appropriated, to the Arkansas Public Employees Retirement
35 System, to be payable from the Arkansas Public Employees' Retirement System

22 SECTION 9. SPECIAL LANGUAGE. NOT TO BE INCORPORATED INTO THE ARKANSAS
23 CODE NOR PUBLISHED SEPARATELY AS SPECIAL, LOCAL AND TEMPORARY LAW. JUDICIAL
24 RETIREMENT FUND TRANSFERS. A sum not to exceed $63,708 in the 2021-2022 2022-
25 2023 fiscal year may be transferred from the Judges Retirement Fund to the
26 Arkansas Public Employees' Retirement System Fund for costs incurred by the
27 Arkansas Public Employees Retirement System in administering the Judicial
28 Retirement System. Such transfer request shall be made to the Chief Fiscal
29 Officer of the State, and upon his approval, said transfer shall be made on
30 his books and those of the Treasurer of the State and the Auditor of the
31 State.
32 The provisions of this section shall be in effect only from July 1, 2021
33 2022 through June 30, 2022 2023.

35 SECTION 10. SPECIAL LANGUAGE. NOT TO BE INCORPORATED INTO THE ARKANSAS
36 CODE NOR PUBLISHED SEPARATELY AS SPECIAL, LOCAL AND TEMPORARY LAW. STATE

1 POLICE RETIREMENT FUND TRANSFERS. A sum not to exceed $117,428 in the 2021-
2 2022 2022-2023 fiscal year may be transferred from the State Police
3 Retirement Fund to the Arkansas Public Employees' Retirement System Fund for
4 costs incurred by the Arkansas Public Employees Retirement System in
5 administering the State Police Retirement System. Such transfer request
6 shall be made to the Chief Fiscal Officer of the State, and upon his
7 approval, said transfer shall be made on his books and those of the Treasurer
8 of the State and the Auditor of the State.
9 The provisions of this section shall be in effect only from July 1, 2021
10 2022 through June 30, 2022 2023.

12 SECTION 11. SPECIAL LANGUAGE. NOT TO BE INCORPORATED INTO THE ARKANSAS
13 CODE NOR PUBLISHED SEPARATELY AS SPECIAL, LOCAL AND TEMPORARY LAW. EXEMPTION
14 FROM PRIOR REVIEW. The Arkansas Public Employees Retirement System is hereby
15 exempted from seeking prior review by the Arkansas Legislative Council or
16 Joint Budget Committee with regard to transfers between the Benefits and
17 Refund line items in the Public Employees Retirement Cash appropriation
18 section and the Benefits-Non Employee line item in the Public Employees
19 Retirement Operations appropriation section which are specifically related to
20 transfers necessitated by the changes in retirees' selection of the method of
21 payment of retirement benefits. All other provisions of Arkansas Code 19-4-
22 522 shall be applicable.
23 The provisions of this section shall be in effect only from July 1, 2021
24 2022 through June 30, 2022 2023.

26 SECTION 12. SPECIAL LANGUAGE. NOT TO BE INCORPORATED INTO THE ARKANSAS
27 CODE NOR PUBLISHED SEPARATELY AS SPECIAL, LOCAL AND TEMPORARY LAW. SPECIAL
28 STATE POLICE RETIREMENT FUND TRANSFERS. A sum not to exceed $50,000 may be
29 transferred from the State Police Retirement Fund to the Arkansas Public
30 Employees' Retirement System Fund to share in the costs incurred by the
31 Arkansas Public Employees Retirement System in the purchase and
32 implementation of a new pension administration system, which will be utilized
33 to administer State Police pension transactions for members and retirees.
34 Said transfer shall sunset at the end of fiscal year 2022 2023. Such
35 transfer request shall be made to the Chief Fiscal officer of the State, and
36 upon his approval, said transfer shall be made on his books and those of the

1 Treasurer of the State and the Auditor of the State.
2 The provisions of this section shall be in effect only from July 1, 2021
3 2022 through June 30, 2022 2023.

5 SECTION 13. SPECIAL LANGUAGE. NOT TO BE INCORPORATED INTO THE ARKANSAS
6 CODE NOR PUBLISHED SEPARATELY AS SPECIAL, LOCAL AND TEMPORARY LAW. SPECIAL
7 JUDICIAL RETIREMENT FUND TRANSFERS. A sum not to exceed $50,000 may be
8 transferred from the Judicial Retirement Fund to the Arkansas Public
9 Employees' Retirement System Fund to share in the costs incurred by the
10 Arkansas Public Employees Retirement System in the purchase and
11 implementation of a new pension administration system, which will be utilized
12 to administer Judicial pension transactions for members and retirees. Said
13 transfer shall sunset at the end of fiscal year 2022 2023. Such transfer
14 request shall be made to the Chief Fiscal Officer of the State, and upon his
15 approval, said transfer shall be made on his books and those of the Treasurer
16 of State and the Auditor of the State.
17 The provisions of this section shall be in effect only from July 1, 2021
18 2022 through June 30, 2022 2023.

20 SECTION 14. COMPLIANCE WITH OTHER LAWS. Disbursement of funds
21 authorized by this act shall be limited to the appropriation for such agency
22 and funds made available by law for the support of such appropriations; and
23 the restrictions of the State Procurement Law, the General Accounting and
24 Budgetary Procedures Law, the Revenue Stabilization Law, the Regular Salary
25 Procedures and Restrictions Act, or their successors, and other fiscal
26 control laws of this State, where applicable, and regulations promulgated by
27 the Department of Finance and Administration, as authorized by law, shall be
28 strictly complied with in disbursement of said funds.
