17                           TO AMEND THE CONDITIONS REQUIRING CERTAIN
18                           MEMBERS OF SCHOOL DISTRICT BOARDS OF
19                           DIRECTORS TO BE UP FOR ELECTION FOLLOWING
20                           REZONING BASED ON THE MOST RECENT FEDERAL
21                           DECENNIAL CENSUS INFORMATION.

24   BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS:

26          SECTION 1.       Arkansas Code  6-13-631(f)(3), concerning an annual school
27   election following a statutorily required rezoning for school districts
28   having a ten percent (10%) or greater minority population based on the most
29   recent federal decennial census information, is amended to read as follows:
30                  (3)(A)      At the annual school election following the rezoning, a
31   new the following members of a school district board of directors shall be
32   elected in accordance with procedures set forth in this section up for
33   election:
34                                  (i)    A board member whose elected term has expired;
35                                  (ii)    A board member who was serving on the school
36   district's board of directors by appointment; and

 1                            (iii)    Any board member who resides in a zone whose
 2   boundaries were redrawn to account for the most recent federal decennial
 3   census information.
 4                      (B)   The length of term for a board member elected under
 5   subdivision (f)(3)(A) of this section shall be as follows:
 6                            (i)     Five (5) years for a board member elected under
 7   subdivision (f)(3)(A)(i) of this section; or
 8                            (ii)    The remainder of the unexpired term for a board
 9   member elected under subdivision (f)(3)(A)(ii) or subdivision (f)(3)(A)(iii)
10   of this section.
