15                           CONCERNING THE PAROLE ELIGIBILITY OF A
16                           PERSON CONVICTED OF AN OFFENSE THAT
17                           INVOLVED A MOVING VIOLATION IN A HIGHWAY
18                           WORK ZONE.

21   BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS:

23          SECTION 1.       Arkansas Code  16-93-612, concerning the date when a
24   felony offense was committed and which parole eligibility statutes apply, is
25   amended to add an additional subsection to read as follows:
26          (g)    For an offender serving a sentence for a felony in which the
27   offender's acts or omissions while operating a motor vehicle resulted in
28   serious physical injury or death to a highway construction worker who was
29   present in a highway construction zone and acting in the course of his or her
30   employment that occurred on or after the effective date of this act,  16-93-
31   623 governs that person's parole eligibility procedures.

33          SECTION 2.       Arkansas Code Title 16, Chapter 93, Subchapter 6, is
34   amended to add an additional section to read as follows:
35          16-93-623.       Parole eligibility procedures  Offenses in highway work
36   zone resulting in death of person.

 1        A person sentenced for a felony in which the person was operating a
 2   motor vehicle and his or her acts or omissions while operating the motor
 3   vehicle resulted in serious physical injury or death to a highway
 4   construction worker who was present in a highway construction zone and acting
 5   in the course of his or her employment that occurred on or after the
 6   effective date of this act is eligible for parole only after having served
 7   one-half () of his or her sentence.
