20 SNACKS IN SCHOOL PROGRAM.

23 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS:

25 SECTION 1. Arkansas Code 20-7-135(c), concerning nutrition and
26 physical activity standards for students, is amended to read as follows:
27 (c) Every school district shall:
28 (1) Prohibit for elementary school students in-school access to
29 vending machines offering food and beverages;
30 (2)(A) Permit students in grades seven through twelve (7-12) in-
31 school access to vending machines offering food and beverages that meet the
32 nutrition standards of the federal Smart Snacks in School program throughout
33 the school day according to the school's health and wellness plan.
34 (B) A school district shall not restrict the times that
35 vending machines under subdivision (c)(2)(A) of this section are powered on
36 or powered off.

1 (C) Subdivision (c)(2)(A) and (B) of this section only
2 apply to schools offering vending machine services;
3 (2)(3) Require schools to include as part of the annual report
4 to parents and the community the amounts and specific sources of funds
5 received and expenditures made from competitive food and beverage contracts;
6 (3)(4) Beginning with kindergarten and then in even-numbered
7 grades, require schools to include as a part of a student health report to
8 parents a body mass index percentile by age for each student; and
9 (4)(A)(5)(A) Permit any parent to refuse to have his or her
10 child's body mass index percentile for age assessed and reported, by
11 providing a written refusal to the school.
12 (B) Students in grades eleven (11) and twelve (12) are
13 exempt from any policy or requirement of a public school or the state for
14 measuring or reporting body mass index.
