22 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS:

24 SECTION 1. Pursuant to 23 of Arkansas Constitution, Amendment 98,
25 also known as the "Arkansas Medical Marijuana Amendment of 2016", Arkansas
26 Constitution, Amendment 98, 4, concerning the administration and
27 enforcement concerning qualifying patients, is amended to add an additional
28 subsection to read as follows:
29 (f) When a patient receives a written certification from a physician,
30 the physician may require the patient to consult with a pharmacist consultant
31 of a dispensary.

33 SECTION 2. Pursuant to 23 of Arkansas Constitution, Amendment 98,
34 also known as the "Arkansas Medical Marijuana Amendment of 2016", Arkansas
35 Constitution, Amendment 98, 8(s), concerning the licensing of dispensaries
36 and cultivation facilities, is amended to add an additional subdivision to

1 read as follows:
2 (3) A dispensary shall:
3 (A) Post signage at the check-in station of the dispensary
4 notifying the qualifying patient of the availability of a pharmacist
5 consultant;
6 (B) Provide to the new qualifying patient of the
7 dispensary a card containing language about a consultation with a pharmacist
8 consultant and the contact information of the pharmacist consultant; and
9 (C) Post information on the website of the dispensary
10 regarding a consultation with a pharmacist consultant, the availability of
11 the pharmacist consultant, and the contact information of the pharmacist
12 consultant.
