21 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS:

23 SECTION 1. Arkansas Code 6-13-1416, concerning voluntary
24 consolidations or annexations of public school districts, is amended to add
25 an additional subsection to read as follows:
26 (h)(1) A receiving district that received an affected district as a
27 result of a voluntary administrative annexation under 6-13-1601 et seq.
28 shall notify all contiguous public school districts of its intent to close a
29 public school campus that is part of an affected district a minimum of (1)
30 year before the closure of the public school campus.
31 (2) An affected district under subdivision (h)(1) of this
32 section shall have been the result of a voluntary administrative annexation
33 under 6-13-1601 et seq. that occurred no more than twenty (20) years ago.
34 (3) Upon receiving notice from the receiving district under
35 subdivision (h)(1) of this section, a contiguous public school district may:
36 (A) Notify the receiving district of its interest in

1 accepting the affected district for purposes of keeping the public school
2 campus open; and
3 (B)(i) Petition the state board to reverse the previous
4 voluntary administrative annexation under 6-13-1601 et seq. and consolidate
5 the affected district into the contiguous public school district.
6 (ii) A petition under subdivision (h)(3)(B)(i) of
7 this section shall include the following without limitation:
8 (a) How the contiguous public school district
9 intends to serve the students of the affected district;
10 (b) Evidence that the consolidation will not
11 cause fiscal hardship on the contiguous public school district; and
12 (c) Evidence that the consolidation will not
13 cause fiscal hardship on the affected district.
