19 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS:

21 SECTION 1. Arkansas Code 16-17-129, concerning a levy to defray the
22 cost of incarcerating city and county prisoners, is amended to add an
23 additional subsection to read as follows:
24 (f) With respect to a violation of 27-37-701 et seq., 27-37-706
25 controls the maximum amount of fines that may be imposed under this section.

27 SECTION 2. Arkansas Code 27-37-706(a), concerning the penalties and
28 court costs for a violation of the mandatory seat belt use law, is amended to
29 read as follows:
30 (a)(1) A person who violates this subchapter shall be subject to a
31 fine not to exceed twenty-five dollars ($25.00), unless a local fine under
32 16-17-129 has also been provided for by law.
33 (2) However, the total amount of the fines levied under this
34 section and 16-17-129 shall not exceed forty-five dollars ($45.00).
35 (3) A person who chooses to pay the fine under this section and
36 16-17-129, if applicable, before his or her first appearance under this

1 subsection, is considered having to have pleaded nolo contendere to the
2 violation.
