13 GROUNDS COMMISSION TO PROMULGATE RULES; AND FOR OTHER
14 PURPOSES.

19 ARTS AND GROUNDS COMMISSION; TO AMEND THE
20 LAW CONCERNING APPOINTMENT OF MEMBERS TO
21 THE CAPITOL ARTS AND GROUNDS COMMISSION;
22 AND TO ALLOW THE PROMULGATION OF RULES.

25 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS:

27 SECTION 1. Arkansas Code 22-3-502(a)(2), concerning the creation and
28 members of the Capitol Arts and Grounds Commission, is amended to read as
29 follows:
30 (2) The commission shall be composed of ten (10) members as
31 follows:
32 (A) The Governor or a designee;
33 (B) The Secretary of State or a designee who shall serve
34 as the commission chair;
35 (C) The Director of the Arkansas Historic Preservation
36 Program;

1 (D) The Secretary of the Department of Parks, Heritage,
2 and Tourism;
3 (E) One (1) licensed landscape architect in this state, to
4 be named by the Secretary of State from a list of at least three (3) names
5 submitted to him or her by the Arkansas Chapter, of the American Society of
6 Landscape Architects, Inc.;
7 (F) One (1) licensed architect in this state, to be named
8 by the Secretary of State from a list of at least three (3) names submitted
9 to him or her by the Arkansas Chapter, of the American Institute of
10 Architects;
11 (G) Two (2) citizen members at large, to be appointed by
12 the Secretary of State, who shall serve four-year terms; and
13 (H) The President Pro Tempore of the Senate shall appoint
14 one (1) nonlegislator to serve at his or her pleasure as a member of the
15 commission, and the Speaker of the House of Representatives shall appoint one
16 (1) nonlegislator to serve at his or her pleasure as a member of the
17 commission.

19 SECTION 2. Arkansas Code 22-3-502(d), concerning the creation and
20 members of the Capitol Arts and Grounds Commission, is amended to read as
21 follows:
22 (d)(1) The terms of office of the members Members of the commission
23 appointed by the Secretary of State shall be four (4) years serve at the
24 pleasure of the Secretary of State.
25 (2)(A)(i) Within ninety (90) days prior to the expiration of the
26 term of office of each professional member, the The Arkansas Chapter,
27 American Society of Landscape Architects, Inc. may shall submit to the
28 Secretary of State, at his or her request, a list of at least three (3) names
29 of licensed landscape architects for each position for which a term expires a
30 vacant licensed landscape architect position.

3 SECTION 3. Arkansas Code 22-3-503, concerning the powers and duties
4 of the Capitol Arts and Grounds Commission, is amended to add an additional
5 subsection to read as follows:
6 (d)(1) The commission may promulgate rules for the orderly discharge
7 of the duties of the commission.
8 (2) In promulgating rules under subdivision (d)(1) of this
9 section, the commission shall follow the procedure set out in the Arkansas
10 Administrative Procedure Act, 25-15-201 et seq.

12 SECTION 4. Arkansas Code 22-3-504(b), concerning requirements for
13 Capitol Arts and Grounds Commission project requests, is amended to read as
14 follows:
15 (b) The Capitol Arts and Grounds Commission may require that the
16 requests applications include:
17 (1) Architectural and landscaping plans, if appropriate, for the
18 project; and
19 (2) Sufficient information to demonstrate compliance with
20 applicable standards for development; and
21 (3) Sufficient information to demonstrate consistency of the
22 project with zoning rules of the Capitol Zoning District Commission.
