18 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS:

20 SECTION 1. Arkansas Code 20-10-801, concerning definitions relating
21 to home healthcare services, is amended to add an additional subdivision to
22 read as follows:
23 (10) "Class C license" means that the applicant is at the time
24 of filing a company that intends to provide skilled nursing tasks in addition
25 to personal care services to private duty and third-party payor sources only.

27 SECTION 2. Arkansas Code 20-10-808, concerning the application for a
28 license to provide home healthcare services, is amended to add an additional
29 subsection to read as follows:
30 (d)(1) An applicant for a Class C license shall provide proof that:
31 (A) The home healthcare agency can adequately provide
32 skilled nursing tasks in addition to home healthcare services by acquiring
33 and maintaining accreditation as a home healthcare agency from the Joint
34 Commission on Accreditation of Healthcare Organizations; and
35 (B) The skilled nursing tasks shall be provided to clients
36 who pay for the skilled nursing tasks privately or through a third-party

1 payor source that is not Medicare or Medicaid.
2 (2) A Class C license shall not:
3 (A) Require a permit of approval from the Health Services
4 Permit Agency or the Health Services Permit Commission; or
5 (B) Have a territory restriction within this state.
