20 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS:

22 SECTION 1. Arkansas Code 20-8-107(a), concerning expansion of
23 facilities or services, is amended to read as follows:
24 (a) Unless otherwise provided in this subchapter, all health
25 facilities seeking to add new beds or perform additional home health services
26 or to expand existing bed capacity or home health services shall apply for a
27 permit approving additional beds or services or expanded bed capacity or
28 services pursuant to procedures and criteria promulgated by the Health
29 Services Permit Commission, except an additional permit shall not be required
30 for home health services agencies currently licensed by the Department of
31 Health to expand geographic service areas if the home health services agency
32 has a primary or branch office located within one hundred (100) miles of the
33 location of the services.

35 SECTION 2. Arkansas Code 20-10-806(b)(3)(B), concerning the
36 administration, rules, and standards of home healthcare services, is amended

1 to read as follows:
2 (B) Not require:
3 (i) A registered nurse to visit a patient every
4 sixty-two (62) days to supervise services; or
5 (ii) For any home healthcare services agency in
6 existence as of April 1, 2021, or licensed afterwards:
7 (a) More than one (1) branch office or other
8 place of business to be physically located in the state; or
9 (b) A separate license indicating a geographic
10 limitation with respect to the provision of services; or
11 (iii) A branch office of a home healthcare services
12 agency that only provides unskilled home healthcare services to be within a
13 one-hundred-mile radius of a patient's home.
