17 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS:

19 SECTION 1. Arkansas Code 5-16-101(a), concerning the elements of the
20 offense of video voyeurism, is amended to read as follows:
21 (a) It is unlawful for a person to use a camera, videotape, photo-
22 optical, photoelectric, or other image recording device for the purpose of
23 secretly observing, viewing, photographing, filming, or videotaping another
24 person who is present in a residence, place of business, school, or other
25 structure, or a room or particular location within that structure, if the
26 other person:
27 (1) Is in a private area out of public view;
28 (2) Has a reasonable expectation of privacy; and
29 (3) Has not consented to the observation observing, viewing,
30 photographing, filming, or videotaping.
