19 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS:

21 SECTION 1. Arkansas Code Title 14, Chapter 1, Subchapter 1, is amended
22 to add an additional section to read as follows:
23 14-1-104. Prohibition on content-based sign restrictions.
24 (a)(1) A municipality, county, horizontal property regime or property
25 owners' association formed under the Horizontal Property Act, 18-13-101 et
26 seq., or landlord shall not restrict in any way the placement of signage on
27 private real or personal property based on content.
28 (2) Subdivision (a)(1) of this section does not apply to signage
29 that is not protected under law, including without limitation obscenity,
30 defamation, fraud, incitement, true threats, and speech integral to conduct
31 that is already criminal conduct.
32 (b) A horizontal property regime or property owners' association
33 formed under the Horizontal Property Act, 18-13-101 et seq., or a landlord
34 that violates this section is subject to a fine of five hundred dollars
35 ($500) per violation.
