8 AN ACT TO MAKE AN APPROPRIATION TO THE DEPARTMENT OF
9 CORRECTIONS - DIVISION OF CORRECTION FOR CAPITAL
10 IMPROVEMENT PROJECTS AND LEASE PAYMENTS; AND FOR
11 OTHER PURPOSES.

20 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS:
21
22 SECTION 1. APPROPRIATION - LEASE PAYMENTS. There is hereby
23 appropriated, to the Department of Corrections - Division of Correction, to
24 be payable from the Development and Enhancement Fund, the following:
25 (A) for lease payments associated with debt service of facilities at
26 Malvern and Newport for additional prison beds, including the Special Needs
27 Unit at Malvern, in a sum not to exceed..........................$14,105,000.

29 SECTION 2. APPROPRIATION - CAPITAL IMPROVEMENT PROJECTS. There is
30 hereby appropriated, to the Department of Corrections, to be payable from the
31 Development and Enhancement Fund, the following:
32 (A) for upgrades to the Tucker Water Treatment Plant, in a sum not to
33 exceed .............................................................$320,450.
34 (B) for construction, replacement, and maintenance of equipment for the
35 East Arkansas Water Waste Project, in a sum not to exceed ..........$613,000.
36 (C) for additional well to provide drinking water to Cummins & Varner

1 Units, in a sum not to exceed ......................................$370,000.
2 (D) for construction, renovation and maintenance for the ORCU Waste
3 Water Project, in a sum not to exceed ..............................$200,000.
4 (E) for construction, renovation and maintenance for the Varner Water
5 Well, in a sum not to exceed .......................................$600,000.
6 (F) for construction, renovation and maintenance of facilities related
7 to water treatment, water wells, and wastewater management for various units,
8 in a sum not to exceed .............................................$896,550.
9 (G) for lethal fence upgrades at various units, in a sum not to exceed
10 ....................................................................$345,000.
11 (H) for lethal fence upgrades at East Arkansas, Pine Bluff, RLW & MAX
12 Units, in a sum not to exceed ......................................$800,000.
13 (I) for lethal fence upgrades at Cummins & Varner Units, in a sum not
14 to exceed ..........................................................$600,000.
15 (J) for fence replacement at Delta, North Central, Wrightsville & Ester
16 Units, in a sum not to exceed ....................................$1,255,000.
17 (K) for replacement, upgrades and additions to current camera security
18 systems at all units, in a sum not to exceed .....................$3,000,000.
19 (L) for construction, renovation and maintenance of facilities and
20 Central Warehouse, in a sum not to exceed ........................$5,000,000.
21 (M) for fire alarm upgrades at various units, in a sum not to exceed
22 ....................................................................$500,000.

24 SECTION 3. APPROPRIATION - PANDEMIC AND CATASTROPHIC NEEDS. There is
25 hereby appropriated, to the Department of Corrections, to be payable from the
26 Development and Enhancement Fund, the following:
27 (A) for contingency payment in case of pandemic, natural or
28 catastrophic disasters, in a sum not to exceed ...................$5,000,000.

30 SECTION 4. APPROPRIATION - VARIOUS FARM PROJECTS. There is hereby
31 appropriated, to the Department of Corrections, to be payable from the
32 Division of Correction Farm Fund, the following:
33 (A) for maintenance, replacement, repair, expansion, construction,
34 equipping, renovation, purchase, improvement, and upgrade of the Department
35 of Corrections - Various Farm Projects, in a sum not to exceed ...$1,000,000.

1 SECTION 5. APPROPRIATION - VARIOUS INDUSTRY PROJECTS. There is hereby
2 appropriated, to the Department of Corrections - Division of Correction, to
3 be payable from the Division of Correction Prison Industry Fund, the
4 following:
5 (A) for maintenance, replacement, repair, expansion, construction,
6 equipping, renovation, purchase, improvement, and upgrade of the Department
7 of Corrections - Various Industry Projects, in a sum not to exceed
8 ..................................................................$1,000,000.

10 SECTION 6. APPROPRIATION - CAPITAL IMPROVEMENT PROJECTS - RIVERSIDE.
11 There is hereby appropriated, to the Department of Corrections - Division of
12 Correction, to be payable from the Development and Enhancement Fund, the
13 following:
14 (A) for capital improvements at Riverside Vocational Technical School,
15 in a sum not to exceed ...........................................$1,000,000.

17 SECTION 7. DISBURSEMENT CONTROLS. (A) No contract may be awarded
18 nor obligations otherwise incurred in relation to the project or projects
19 described herein in excess of the State Treasury funds actually available
20 therefor as provided by law. Provided, however, that institutions and
21 agencies listed herein shall have the authority to accept and use grants and
22 donations including Federal funds, and to use its unobligated cash income or
23 funds, or both available to it, for the purpose of supplementing the State
24 Treasury funds for financing the entire costs of the project or projects
25 enumerated herein. Provided further, that the appropriations and funds
26 otherwise provided by the General Assembly for Maintenance and General
27 Operations of the agency or institutions receiving appropriation herein shall
28 not be used for any of the purposes as appropriated in this act.
29 (B) The restrictions of any applicable provisions of the State
30 Purchasing Law, the General Accounting and Budgetary Procedures Law, the
31 Revenue Stabilization Law and any other applicable fiscal control laws of
32 this State and regulations promulgated by the Department of Finance and
33 Administration, as authorized by law, shall be strictly complied with in
34 disbursement of any funds provided by this act unless specifically provided
35 otherwise by law.

1 SECTION 8. LEGISLATIVE INTENT. It is the intent of the General
2 Assembly that any funds disbursed under the authority of the appropriations
3 contained in this act shall be in compliance with the stated reasons for
4 which this act was adopted, as evidenced by the Agency Requests, Executive
5 Recommendations and Legislative Recommendations contained in the budget
6 manuals prepared by the Department of Finance and Administration, letters, or
7 summarized oral testimony in the official minutes of the Arkansas Legislative
8 Council or Joint Budget Committee which relate to its passage and adoption.

10 SECTION 9. EMERGENCY CLAUSE. It is found and determined by the General
11 Assembly, that the Constitution of the State of Arkansas prohibits the
12 appropriation of funds for more than a one (1) year period; that the
13 effectiveness of this Act on July 1, 2021 is essential to the operation of
14 the agency for which the appropriations in this Act are provided, and that in
15 the event of an extension of the legislative session, the delay in the
16 effective date of this Act beyond July 1, 2021 could work irreparable harm
17 upon the proper administration and provision of essential governmental
18 programs. Therefore, an emergency is hereby declared to exist and this Act
19 being necessary for the immediate preservation of the public peace, health
20 and safety shall be in full force and effect from and after July 1, 2021.
