17 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS:

19 SECTION 1. Arkansas Code 23-115-404(a), concerning confidential
20 information collected by the Office of the Arkansas Lottery, is amended to
21 read as follows:
22 (a)(1) Except as otherwise provided in subdivision (a)(2) of this
23 section subsection, the Office of the Arkansas Lottery shall comply with the
24 Freedom of Information Act of 1967, 25-19-101 et seq.
25 (2) The following records or information shall be treated as
26 confidential and are exempt from public disclosure under the Freedom of
27 Information Act of 1967, 25-19-101 et seq.:
28 (A) Information pertaining to the security of lottery
29 games and lottery operations, including without limitation:
30 (i) Security measures, systems, or procedures; and
31 (ii) Security reports; and
32 (B) Any records exempt from disclosure under the Freedom
33 of Information Act of 1967, 25-19-101 et seq.
34 (3)(A) Except as provided under subdivision (a)(3)(B) of this
35 section, if a lottery winner who wins more than five hundred thousand dollars
36 ($500,000) requests that his or her records or information filed with the

1 Office of the Arkansas Lottery remain confidential, the records or
2 information filed with the Office of the Arkansas Lottery shall be treated as
3 confidential and are exempt from public disclosure under the Freedom of
4 Information Act of 1967, 25-19-101 et seq.
5 (B)(i) However, the records or information of a lottery
6 winner shall remain confidential under subdivision (a)(3)(A) of this section
7 for only six (6) months if the lottery winner is an elected official or an
8 individual who is related in the second degree of consanguinity to an elected
9 official.
10 (ii) As used in subdivision (a)(3)(B)(i) of this
11 section, "elected official" means a person who holds an elected office of a
12 governmental body, whether elected or appointed to the office.
13 (C) Records or information filed with the Office of the
14 Arkansas Lottery and treated as confidential under subdivision (a)(3)(A) of
15 this section shall become public after three (3) years.
