17 FOR A DRIVER WHO FAILS TO REMAIN AT THE
18 SCENE OF AN ACCIDENT THAT RESULTS IN
19 DEATH OR PERSONAL INJURY.

22 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS:

24 SECTION 1. Arkansas Code 5-1-109(a)(1), concerning the statute of
25 limitations for the prosecution of certain offenses, is amended to add an
26 additional subdivision to read as follows:
27 (N) A violation of 27-53-101(a).

29 SECTION 2. Arkansas Code 27-53-101(b), concerning the penalty for
30 failing to remain at the scene of an accident involving death or personal
31 injuries, is amended to read as follows:
32 (b)(1) Any person failing to comply with subsection (a) of this
33 section or with 27-53-103 shall upon conviction be deemed guilty of a Class
34 D A felony.
35 (2)(A) The Commissioner of Motor Vehicles Secretary of the
36 Department of Finance and Administration shall revoke the driver's license or

1 commercial driver's license of the a person so convicted convicted of failing
2 to comply with subsection (a) of this section or with 27-53-103.
3 (B) However, a revocation under subdivision (b)(2)(A) of
4 this section for an accident resulting in the death of any person shall not
5 be subject to reinstatement at any time by the secretary.
