14 AUTHORIZATION FOR CASINO GAMING IN POPE
15 COUNTY.

18 BE IT RESOLVED BY THE HOUSE OF REPRESENTATIVES OF THE NINETY-THIRD GENERAL
19 ASSEMBLY OF THE STATE OF ARKANSAS, AND BY THE SENATE, A MAJORITY OF ALL
20 MEMBERS ELECTED TO EACH HOUSE AGREEING THERETO:

22 THAT the following is proposed as an amendment to the Constitution of
23 the State of Arkansas, and upon being submitted to the electors of the state
24 for approval or rejection at the next general election for Representatives
25 and Senators, if a majority of the electors voting thereon at the election
26 adopt the amendment, the amendment shall become a part of the Constitution of
27 the State of Arkansas, to wit:

29 SECTION 1. Arkansas Constitution, Amendment 100, 4, subsections (i)
30 - (n), are amended to read as follows:
31 (i) The Arkansas Racing Commission shall issue four three casino
32 licenses.
33 (j) The Arkansas Racing Commission shall issue a casino license, as
34 provided in this Amendment, to a Franchise holder located in Crittenden
35 County, there being only one, to conduct casino gaming at a casino to be
36 located at or adjacent to the Franchise holder's greyhound racing track and

1 gaming facility as of December 31, 2017 in Crittenden County. The Arkansas
2 Racing Commission shall also issue a casino license, as provided in this
3 Amendment, to a Franchise holder located in Garland County, there being only
4 one, to conduct casino gaming at a casino to be located at or adjacent to the
5 Franchise holder's horse racing track and gaming facility as of December 31,
6 2017 in Garland County. Casino licenses to be issued to Franchise holders
7 shall be issued upon:
8 (1) Adoption by the Arkansas Racing Commission of rules
9 necessary to carry out the purposes of this Amendment; and
10 (2) Initial laws and appropriations required by this Amendment
11 being in full force and effect.
12 (k) The Arkansas Racing Commission shall award a casino license to a
13 casino applicant for a casino to be located in Pope County within two miles
14 of the city limits of the county seat. The Arkansas Racing Commission shall
15 also award a casino license to a casino applicant for a casino to be located
16 in Jefferson County within two miles of the city limits of the county seat.
17 (l) Casino licensees are required to conduct casino gaming for as long
18 as they have a license.
19 (m) The Arkansas Racing Commission shall require all casino applicants
20 for a casino license in Pope County and Jefferson County to demonstrate
21 experience conducting casino gaming.
22 (n) The Arkansas Racing Commission shall require all casino applicants
23 for a casino license in Pope County and Jefferson County to submit either a
24 letter of support from the county judge or a resolution from the quorum court
25 in the county where the proposed casino is to be located Jefferson County
26 and, if the proposed casino is to be located within a city or town, shall
27 also require all casino applicants to include a letter of support from the
28 mayor in the city or town where the applicant is proposing the casino to be
29 located.

31 SECTION 2. EFFECTIVE DATE. This amendment shall be effective on and
32 after November 9, 2022.

34 SECTION 3. RETROACTIVITY. This amendment is retroactive to November
35 14, 2018.

1 SECTION 4. BALLOT TITLE AND POPULAR NAME. When this proposed
2 amendment is submitted to the electors of this state on the general election
3 ballot:
4 (1) The title of this Joint Resolution shall be the ballot
5 title; and
6 (2) The popular name shall be "A Constitutional Amendment to
7 Remove the Authorization for Casino Gaming in Pope County".
