19 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS:

21 SECTION 1. Arkansas Code 14-56-204(c), concerning municipal
22 regulation of residential building design elements, is amended to add an
23 additional subdivision to read as follows:
24 (3) As used in this section, "existing property" means land
25 within a geographic boundary or district as defined by a municipal policy,
26 regulation, or ordinance on or before February 28, 2019.

28 SECTION 2. Arkansas Code 14-56-204(d)(10), concerning municipal
29 regulation of residential building design elements, is amended to read as
30 follows:
31 (10) The application of a municipal policy, regulation, or
32 ordinance affecting residential building design elements if the application:
33 (A) Is applied on an existing property in which
34 residential design elements were regulated on or before February 28, 2019,
35 but not as to any other property thereafter;
36 (B) Results in a less restrictive regulation of

1 residential building design elements on existing property than the municipal
2 policy, regulation, or ordinance as it existed on February 28, 2019; or
3 (C) Does not affect residential building design elements;
