22 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS:

24 SECTION 1. Arkansas Code Title 26, Chapter 52, Subchapter 4, is
25 amended to add an additional section to read as follows:
26 26-52-453. Used motor vehicles.
27 The gross receipts or gross proceeds derived from the sale of a used
28 motor vehicle are exempt from the gross receipts tax levied by this chapter
29 and the compensating use tax levied by the Arkansas Compensating Tax Act of
30 1949, 26-53-101 et seq.

32 SECTION 2. Arkansas Code 26-52-510 is amended to read as follows:
33 26-52-510. Direct payment of tax by consumer-user New and used motor
34 vehicles, and new and used trailers, or semitrailers Definition.
35 (a)(1) On or before the time for registration as prescribed by 27-
36 14-903(a), a consumer shall pay to the Secretary of the Department of Finance

1 and Administration the tax levied by this chapter and all other gross
2 receipts taxes levied by the state with respect to the sale of a new or used
3 motor vehicle, or a new or used trailer, or semitrailer required to be
4 licensed in this state, instead of the taxes being collected by the dealer or
5 seller.
6 (2) The secretary shall require the payment of the taxes at the
7 time of registration before issuing a license for the new or used motor
8 vehicle, or the new or used trailer, or semitrailer.
9 (3)(A) The taxes apply regardless of whether the motor vehicle,
10 trailer, or semitrailer is sold by a vehicle dealer or an individual,
11 corporation, or partnership not licensed as a vehicle dealer.
12 (B) The exemption in 26-52-401(17) for isolated sales
13 does not apply to the sale of a motor vehicle, trailer, or semitrailer.
14 (4) If the consumer fails to pay the taxes when due:
15 (A) There is assessed a penalty equal to ten percent (10%)
16 of the amount of taxes due; and
17 (B) The consumer shall pay to the secretary the penalty
18 under subdivision (a)(4)(A) of this section and the taxes due before the
19 secretary issues a license for the motor vehicle, trailer, or semitrailer.
20 (b)(1)(A) Except as provided in this section, when a used motor
21 vehicle, trailer, or semitrailer is taken in trade as a credit or part
22 payment on the sale of a new or used motor vehicle, or a new or used trailer,
23 or semitrailer, the tax levied by this chapter and all other gross receipts
24 taxes levied by the state shall be paid on the net difference between the
25 total consideration for the new or used motor vehicle, or the new or used
26 trailer, or semitrailer sold and the credit for the used motor vehicle,
27 trailer, or semitrailer taken in trade.
28 (B) However, if the total consideration for the sale of
29 the new or used motor vehicle, or the new or used trailer, or semitrailer is
30 less than four thousand dollars ($4,000), no tax shall be is due.
31 (C)(i) When a used motor vehicle, trailer, or semitrailer
32 is sold by a consumer, rather than traded-in as a credit or part payment on
33 the sale of a new or used motor vehicle, or a new or used trailer, or
34 semitrailer, and the consumer subsequently purchases a new or used motor
35 vehicle, or a new or used trailer, or semitrailer of greater value within
36 forty-five (45) days of the sale, the tax levied by this chapter and all

1 other gross receipts taxes levied by the state shall be paid on the net
2 difference between the total consideration for the new or used motor vehicle,
3 or the new or used trailer, or semitrailer purchased subsequently and the
4 amount received from the sale of the used motor vehicle, trailer, or
5 semitrailer sold in lieu of a trade-in.
6 (ii)(a) Upon registration of the new or used motor
7 vehicle, a consumer claiming the deduction provided by subdivision
8 (b)(1)(C)(i) of this section shall provide a bill of sale signed by all
9 parties to the transaction which that reflects the total consideration paid
10 to the seller for the new motor vehicle.
11 (b) A copy of the bill of sale shall be
12 deposited with the revenue office at the time of registration of the new or
13 used motor vehicle.
14 (c) The deduction provided by this section
15 shall not be allowed unless the taxpayer claiming the deduction provides a
16 copy of a bill of sale signed by all parties to the transaction which that
17 reflects the total consideration paid to the seller for the new motor
18 vehicle.
19 (iii) If the taxpayer claiming the deduction
20 provided in this section fails to provide a bill of sale signed by all
21 parties to the transaction which that reflects the total consideration paid
22 to the seller for the vehicle, tax shall be is due on the total consideration
23 paid for the new or used motor vehicle, or the new or used trailer, or
24 semitrailer without any deduction for the value of the item sold.
25 (2)(A)(i) When a motor vehicle dealer removes a motor vehicle
26 from its inventory and the motor vehicle is used by the dealership as a
27 service vehicle, the dealer shall register the motor vehicle, obtain a
28 certificate of title, and pay sales tax on the listed retail price of the new
29 motor vehicle.
30 (ii)(a) When the motor vehicle dealer returns the
31 service vehicle to inventory as a used motor vehicle and replaces it with a
32 new motor vehicle for dealership use as a service vehicle, the dealer shall
33 pay sales tax on the difference between the listed retail price of the new
34 service vehicle to be used by the dealership and the value of the used
35 service vehicle being returned to inventory.
36 (b) The value of the used service vehicle

1 shall be the highest listed wholesale price reflected in the most current
2 edition of the National Automobile Dealers Association's Official Used Car
3 Guide.
4 (B)(i) As used in this subsection, service vehicle means
5 a motor vehicle driven exclusively by an employee of the dealership and used
6 either to transport dealership customers or dealership parts and equipment.
7 (ii) Service vehicle does not include motor
8 vehicles which that are rented by the dealership, used as demonstration
9 vehicles, used by dealership employees for personal use, or used to haul or
10 pull other vehicles.
11 (c) All parts and accessories purchased by motor vehicle sellers for
12 resale or used by them for the reconditioning or rebuilding of used motor
13 vehicles intended for resale are exempt from gross receipts tax, provided
14 that the motor vehicle seller meets the requirements of 26-52-401(12)(A)
15 and applicable rules promulgated by the secretary.
16 (d) Nothing in this section shall be construed to This section does
17 not repeal any exemption from this chapter.
18 (e) A credit is not allowed for sales or use taxes paid to another
19 state with respect to the purchase of a motor vehicle, trailer, or
20 semitrailer that was first registered by the purchaser in Arkansas.
21 (f)(1)(A) Any motor vehicle dealer licensed pursuant to 27-14-
22 601(a)(6) who has purchased a used motor vehicle upon payment of all
23 applicable registration and title fees may register the vehicle for the sole
24 purpose of obtaining a certificate of title to the vehicle without payment of
25 gross receipts tax, except as provided in subdivision (f)(1)(B) of this
26 section.
27 (B)(i) The sale of a motor vehicle from the original
28 franchise dealer to any other dealer, person, corporation, or other entity
29 other than a franchise dealer of the same make of vehicle and which sale is
30 reflected on the statement of origin shall be subject to gross receipts tax.
31 (ii) The vehicle shall be considered a used motor
32 vehicle which shall be registered and titled, and tax shall be paid at the
33 time of registration.
34 (iii) The provisions of subdivision (f)(1)(A) of
35 this section shall not apply in those instances.
36 (2) No license plate shall be provided with the registration,

1 and the used vehicle titled by a dealer under this subsection may not be
2 operated on the public highways unless there is displayed on the used vehicle
3 a dealer's license plate issued under the provisions of 27-14-
4 601(a)(6)(B)(ii).
5 (g)(1)(A) For purposes of this section, the total consideration for a
6 used motor vehicle shall be presumed to be the greater of the actual sales
7 price as provided on the bill of sale, invoice or financing agreement, or the
8 average loan value price of the vehicle as listed in the most current edition
9 of a publication which is generally accepted by the industry as providing an
10 accurate valuation of used vehicles.
11 (B) If the published loan value exceeds the invoiced
12 price, then the taxpayer must establish to the secretary's satisfaction that
13 the price reflected on the invoice or other document is true and correct.
14 (C) If the secretary determines that the invoiced price is
15 not the actual selling price of the vehicle, then the total consideration
16 will be deemed to be the published loan value.
17 (2)(A) For purposes of this section, the total consideration for
18 a new or used trailer or semitrailer shall be is the actual sales price as
19 provided on a bill of sale, invoice, or financing agreement.
20 (B)(2) The secretary may require additional information to
21 conclusively establish the true selling price of the new or used trailer or
22 semitrailer.

24 SECTION 3. Arkansas Code 26-53-126 is amended to read as follows:
25 26-53-126. Tax on new and used motor vehicles, and new and used
26 trailers, or semitrailers Payment and collection.
27 (a)(1) Upon being registered in this state, a new or used motor
28 vehicle, or a new or used trailer, or semitrailer required to be licensed in
29 this state is subject to the tax levied in this subchapter and all other use
30 taxes levied by the state regardless of whether the motor vehicle, trailer,
31 or semitrailer was purchased from a dealer or an individual.
32 (2)(A) On or before the time for registration as prescribed by
33 27-14-903(a), the person making application to register the motor vehicle,
34 trailer, or semitrailer shall pay the taxes to the Secretary of the
35 Department of Finance and Administration instead of the taxes being collected
36 by the dealer or individual seller.

1 (B) The secretary shall collect the taxes before issuing a
2 license for the motor vehicle, trailer, or semitrailer.
3 (3) The exemption in 26-52-401(17) for isolated sales does not
4 apply to the sale of a motor vehicle, trailer, or semitrailer.
5 (4) If the person making application to register the motor
6 vehicle, trailer, or semitrailer fails to pay the taxes when due:
7 (A) There is assessed a penalty equal to ten percent (10%)
8 of the amount of taxes due; and
9 (B) The person making application to register the motor
10 vehicle, trailer, or semitrailer shall pay to the secretary the penalty under
11 subdivision (a)(4)(A) of this section and the taxes due before the secretary
12 issues a license for the motor vehicle, trailer, or semitrailer.
13 (b)(1) When a used motor vehicle, trailer, or semitrailer is taken in
14 trade as a credit or part payment on the sale of a new or used motor vehicle,
15 or a new or used trailer, or semitrailer, the tax levied in this subchapter
16 and all other use taxes levied by the state shall be paid on the net
17 difference between the total consideration for the new or used motor vehicle,
18 or the new or used trailer, or semitrailer sold and the credit for the used
19 motor vehicle, trailer, or semitrailer taken in trade.
20 (2) However, if the total consideration for the sale of the new
21 or used motor vehicle, or the new or used trailer, or semitrailer is less
22 than four thousand dollars ($4,000), no tax shall be is due.
23 (3)(A) When a used motor vehicle, trailer, or semitrailer is
24 sold by a consumer, rather than traded in as a credit or part payment on the
25 sale of a new or used motor vehicle, or a new or used trailer, or
26 semitrailer, and the consumer subsequently purchases a new or used motor
27 vehicle, or a new or used trailer, or semitrailer of greater value within
28 forty-five (45) days of the sale, the tax levied by this chapter and all
29 other gross receipts taxes levied by the state shall be paid on the net
30 difference between the total consideration for the new or used motor vehicle,
31 or the new or used trailer, or semitrailer purchased subsequently and the
32 amount received from the sale of the used motor vehicle, trailer, or
33 semitrailer sold in lieu of a trade-in.
34 (B)(i) Upon registration of the new or used motor vehicle,
35 consumers claiming the deduction provided by subdivision (b)(3)(A) of this
36 section shall provide a bill of sale signed by all parties to the transaction

1 which that reflects the total consideration paid to the seller for the new
2 motor vehicle.
3 (ii) A copy of the bill of sale shall be deposited
4 with the revenue office at the time of registration of the new or used motor
5 vehicle.
6 (iii) The deduction provided by this subdivision
7 (b)(3) shall not be allowed unless the taxpayer claiming the deduction
8 provides a copy of a bill of sale signed by all parties to the transaction
9 which that reflects the total consideration paid to the seller for the new
10 motor vehicle.
11 (C) If the taxpayer claiming the deduction provided in
12 this subdivision (b)(3) fails to provide a bill of sale signed by all parties
13 to the transaction which that reflects the total consideration paid to the
14 seller for the vehicle, tax shall be is due on the total consideration paid
15 for the new or used motor vehicle, or the new or used trailer, or semitrailer
16 without any deduction for the value of the item sold.
17 (c) The tax imposed by this subchapter shall does not apply to a motor
18 vehicle, trailer, or semitrailer to be registered by a bona fide nonresident
19 of this state.
20 (d) Nothing in this section shall be construed to This section does
21 not repeal any exemption from this subchapter.
22 (e)(1) Upon payment of all applicable registration and title fees, any
23 motor vehicle dealer licensed pursuant to 27-14-601(a)(6) who has purchased
24 a used motor vehicle may register the vehicle for the sole purpose of
25 obtaining a certificate of title to the vehicle without payment of use tax.
26 (2) No license plate shall be provided with the registration,
27 and the used vehicle titled by a dealer under this subsection may not be
28 operated on the public highways unless there is displayed on the used vehicle
29 a dealer's license plate issued under the provisions of 27-14-
30 601(a)(6)(B)(ii).
