19 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS:

21 SECTION 1. Arkansas Code 12-9-209 is amended to read as follows:
22 12-9-209. Reimbursement for training costs or expenses.
23 (a)(1) If a county, city, town, or state agency pays the cost costs or
24 expenses for training a law enforcement officer at a state-funded or
25 municipally operated law enforcement training academy and another county,
26 city, town, or state agency employs that law enforcement officer within
27 eighteen (18) months after completion of the training in a position requiring
28 a certificate of training from the a state-funded or municipally operated law
29 enforcement training academy, the county, city, town, or state agency so
30 employing that employs the law enforcement officer, at the time of employing
31 the law enforcement officer, shall reimburse the county, city, town, or state
32 agency for all or a portion of the costs or expenses incurred by the county,
33 city, town, or state agency for the training of the law enforcement officer
34 at the state-funded or municipally operated law enforcement training academy,
35 unless the law enforcement officer has been terminated by the county, city,
36 town, or state agency that paid the costs or expenses of training, in which

1 case no reimbursement is required from the county, city, town, or state
2 agency hiring employing the law enforcement officer.
3 (2) Reimbursement may be sought only from the first county,
4 city, town, or state agency that employed the law enforcement officer after
5 the county, city, town, or state agency paid the costs or expenses of
6 training.
7 (3) Reimbursement shall include any salary, travel expenses,
8 food, lodging, or other costs required to be paid by the county, city, town,
9 or state agency, as follows:
10 (A) If the person law enforcement officer is employed
11 within two (2) months after completion of the training, the employing agency
12 shall reimburse the total cost of the training of the costs or expenses of
13 training;
14 (B) If the person law enforcement officer is employed more
15 than two (2) months but not more than six (6) months after completion of the
16 training, the employing agency shall reimburse eighty percent (80%) of the
17 cost of the costs or expenses of training;
18 (C) If the person law enforcement officer is employed more
19 than six (6) months but not more than ten (10) months after completion of the
20 training, the employing agency shall reimburse sixty percent (60%) of the
21 cost of the costs or expenses of training;
22 (D) If the person law enforcement officer is employed more
23 than ten (10) months but not more than fourteen (14) months after completion
24 of the training, the employing agency shall reimburse forty percent (40%) of
25 the cost of the costs or expenses of training; or
26 (E) If the person law enforcement officer is employed more
27 than fourteen (14) months but not more than eighteen (18) months after
28 completion of the training, the employing agency shall reimburse twenty
29 percent (20%) of the cost of the costs or expenses of training.
30 (b)(1) If any county, city, town, or state agency which that employs
31 an a law enforcement officer whose training expense was costs or expenses of
32 training were paid by another county, city, town, or state agency fails to
33 make reimbursement for the expenses costs or expenses of training as required
34 in subsection (a) of this section, the county, city, town, or state agency
35 entitled to reimbursement shall notify the Treasurer of State.
36 (2) The Treasurer of State shall then withhold the amount of the

1 reimbursement due for training the law enforcement officer from the county or
2 municipal aid of the employing county, city, town, or state agency or from
3 funds appropriated to the employing state agency and shall remit the amount
4 to the county, city, town, or state agency which that is entitled to the
5 reimbursement under the provisions of this section.
