20 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS:

22 SECTION 1. Arkansas Code 27-35-109(b), concerning the liability for
23 damage to a highway or structure, is amended to read as follows:
24 (b) Any A person driving any a vehicle, object, or contrivance upon
25 any a highway shall be liable for all damages to structures spanning the
26 highway, or a part of the highway, by reason of load heights in excess of
27 that which the structure will permit, when the clearance height of the
28 structure is posted, and in any event where the height of the vehicle and
29 load is in excess of thirteen fourteen feet six inches (13' 6") (14').

31 SECTION 2. Arkansas Code 27-35-207 is amended to read as follows:
32 27-35-207. Height of vehicles.
33 No A vehicle operated upon the highways of this state, unladen or with
34 load, shall not exceed a height of thirteen fourteen feet, six inches (13'
35 6") (14'), unless a greater height is authorized by a special permit issued
36 by competent authority as provided in 27-35-210 APPROVED: 4/23/21
