23 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS:

25 SECTION 1. Arkansas Code 3-9-202(12), concerning a definition
26 related to on-premises consumption of alcoholic beverages, is amended to read
27 as follows:
28 (12) On-premises consumption means the sale of alcoholic
29 beverages by the drink or in broken or unsealed containers for consumption on
30 the premises where sold or within the boundaries of a designated
31 entertainment district established under 14-54-1412 that is contiguous with
32 the premises;

34 SECTION 2. Arkansas Code 14-54-1412(a)(2), concerning the definition
35 of a "designated entertainment district", is amended to read as follows:
36 (2) Contains any number and any combination of restaurants,

1 taprooms, taverns, entertainment establishments, hospitality establishments,
2 music venues, theaters, bars, private clubs, art galleries, art studios,
3 tourist destinations, distilleries, dance clubs, cinemas, or concert halls.

5 SECTION 3. Arkansas Code 14-54-1412(b)(1), concerning the creation
6 of a designated entertainment district by a city, municipality, or
7 incorporated town, is amended to read as follows:
8 (b)(1) A city, a municipality, or an incorporated town collecting a
9 gross receipts tax on prepared food or hotel and motel accommodations under
10 26-75-602 26-75-613 and located in a county with established entities
11 authorized by the Alcoholic Beverage Control Division to sell alcoholic
12 beverages may by ordinance create a designated entertainment district.
