23 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS:

25 SECTION 1. Arkansas Code 2-16-206(a), concerning the State Plant
26 Board, is amended to read as follows:
27 (a) There is created and established a State Plant Board, composed of
28 eighteen (18) nineteen (19) members, as follows:
29 (1) Two (2) nonvoting members designated by the Vice President
30 for Agriculture of the University of Arkansas or his or her designee;
31 (2) A practical cotton grower, actively and principally engaged
32 in the business production of cotton, to be appointed by the Governor and
33 confirmed by the Senate;
34 (3) One (1) member to represent the fertilizer industry shall be
35 appointed by the Governor and confirmed by the Senate from a list of at least
36 two (2) names submitted by the Arkansas Plant Food Association, actively

1 engaged in the business, to be appointed by the Governor;
2 (4) A practical rice grower, actively and principally engaged in
3 the business production of rice, to be appointed by the Governor and
4 confirmed by the Senate;
5 (5) A practical horticulturist or nurseryman, actively and
6 principally engaged in the business, to be elected by the Arkansas State
7 Horticultural Society to be appointed by the Governor and confirmed by the
8 Senate from a list of at least two (2) names submitted by the Arkansas State
9 Horticultural Society and the Arkansas Green Industry Association;
10 (6) A nurseryman practical corn, peanut, sorghum, turf, or wheat
11 grower, actively and principally engaged in the business production of corn,
12 peanuts, sorghum, turf, or wheat, to be elected by the Arkansas Green
13 Industry Association to be appointed by the Governor and confirmed by the
14 Senate;
15 (7) A practical seed soybean grower, actively and principally
16 engaged in the business production of soybeans, to be elected by the Arkansas
17 Seed Growers Association to be appointed by the Governor and confirmed by the
18 Senate;
19 (8) A One (1) member representing pest control operator,
20 operators actively engaged in the business, to be elected by shall be
21 appointed by the Governor and confirmed by the Senate from a list of at least
22 two (2) names submitted by the Arkansas Pest Management Association, Inc.;
23 (9) A seed dealer, actively and principally engaged in the
24 business, to be elected by the Arkansas Seed Dealers' Association to be
25 appointed by the Governor and confirmed by the Senate from a list of at least
26 two (2) names submitted by the Arkansas Seed Dealers' Association;
27 (10) A seed grower, actively and principally engaged in the
28 business, to be appointed by the Governor and confirmed by the Senate from a
29 list of at least two (2) names submitted by the Arkansas Seed Growers
30 Association;
31 (10)(11) One (1) member representing the Arkansas Bureau of
32 Standards retail or wholesale fuel industry to be appointed by shall be
33 appointed by the Governor and confirmed by the Senate from a list of at least
34 two (2) names submitted by the Arkansas Oil Marketers Association;
35 (11)(12) A One (1) member representing pesticide manufacturer,
36 manufacturers actively engaged in the business, to be elected by shall be

1 appointed by the Governor and confirmed by the Senate from a list of at least
2 two (2) names submitted by the Arkansas Crop Protection Association, Inc.;
3 (12)(13) One (1) member to represent the Arkansas Agricultural
4 Aviation Association, to be elected by representing agricultural aviators to
5 be appointed by the Governor and confirmed by the Senate from a list of at
6 least two (2) names submitted by the Arkansas Agricultural Aviation
7 Association;
8 (13)(14) One (1) member to represent the Arkansas Forestry
9 Association, to be elected by representing the forest sector shall be
10 appointed by the Governor and confirmed by the Senate from a list of at least
11 two (2) names submitted by the Arkansas Forestry Association;
12 (14)(15) Two (2) farmers actively and principally engaged in
13 farming the production of corn, cotton, peanuts, rice, sorghum, soybeans,
14 turf, or wheat in this state, appointed by the Governor and confirmed by the
15 Senate;
16 (15)(16) One (1) representative of the livestock industry A
17 practical livestock producer, actively and principally engaged in the
18 business production of livestock, to be appointed by the Governor and
19 confirmed by the Senate; and
20 (16)(17) One (1) representative of the forage industry A
21 practical forage grower, actively and principally engaged in the business
22 production of forage, to be appointed by the Governor and confirmed by the
23 Senate.

25 SECTION 2. DO NOT CODIFY. Remainder of term.
26 Current members of the State Plant Board shall serve out the remainder
27 of their terms and are not required to be replaced to meet the changes of
28 this act.
