11 POLICE AND FIRE RETIREMENT SYSTEM; AND FOR OTHER

17 REEMPLOYMENT OF CERTAIN RETIRED MEMBERS
18 OF THE ARKANSAS LOCAL POLICE AND FIRE
19 RETIREMENT SYSTEM.

22 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS:

24 SECTION 1. Arkansas Code 24-10-504(e)(1), concerning forfeiture and
25 restoration under the Arkansas Local Police and Fire Retirement System, is
26 amended to read as follows:
27 (e)(1) Regardless of whether a retirant was a participant in the Local
28 Police and Fire Deferred Retirement Option Plan or retired under 24-10-606,
29 a retirant may return to employment after he or she retires if the retirant:
30 (A) Was a retirant for at least one hundred eighty (180)
31 ninety (90) days;
32 (B) In a manner prescribed by the system, waives his or
33 her right to any benefit accrual, including without limitation a benefit
34 provided under 24-10-607; and
35 (C) Either:
36 (i) Returns to a covered employer other than the

1 covered employer or covered employers from which he or she retired; or
2 (ii)(a) Returns to employment in an entry level
3 position with the covered employer from which he or she retired.
4 (b) Subdivision (e)(1)(C)(ii)(a) of this
5 section does not apply to a retirant who returns to employment in a position
6 appointed by a mayor, city manager, or city administrator.

8 SECTION 2. Arkansas Code 24-10-504(e), concerning forfeiture and
9 restoration under the Arkansas Local Police and Fire Retirement System, is
10 amended to add an additional subdivision to read as follows:
11 (7) A retirant who retired before the January 1, 2020, effective
12 date of Acts 2019, No. 988, may return to employment as provided by this
13 subsection.
