16 CONTRACTS, REPORTS, AND RECORDS OF PEST
17 CONTROL SERVICES.

20 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS:

22 SECTION 1. Arkansas Code 17-37-221(c), concerning contracts,
23 reports, and records of pest control operators, is amended to read as
24 follows:
25 (c)(1)(A) By the fifteenth of each month, every licensed operator
26 shall file a report with the board covering termite and other structural pest
27 work performed the previous calendar month, along with a copy of each
28 contract issued for the prevention, control, or eradication of termites and
29 other structural pests and any other information deemed necessary by the
30 board and stipulated in the rules made under authority of this chapter.
31 (B) The report required under subdivision (c)(1)(A) of
32 this section shall include:
33 (i) A summary listing of each contract issued for
34 the prevention, control, or eradication of termites or other structural
35 pests;
36 (ii) Letters of clearance issued and service

1 contracts issued regardless of whether chemical treatments were carried out;
2 (iii) The name and address of the property owner;
3 (iv) The address of the property; and
4 (v) Any other information deemed necessary by the
5 board and stipulated in the rules adopted under this chapter.
6 (C) Within forty-eight (48) normal business hours, the
7 licensed operator shall produce documents requested by an authorized agent of
8 the board, including without limitation contracts and related documents.
9 (D) Failure to meet timelines set in this section may
10 result in additional penalties.
11 (2)(A) Reporting and payment of inspection fees may also be
12 required for household pest and rodent control work or such other
13 classifications as the board may specify if deemed necessary or if required
14 by the Federal Insecticide, Fungicide, and Rodenticide Act.
15 (B)(i) All fees due the board shall be filed with the
16 board by the fifteenth day of each month to cover work performed the previous
17 calendar month.
18 (ii) If payment of fees due is delayed more than
19 thirty (30) days, then the fees due shall be doubled.
20 (3) In addition, the reports shall include letters of clearance
21 issued and service contracts issued even though no chemical treatments were
22 carried out. Each report shall list the name and address of the owner,
23 address of the property, length and nature of the guarantee, date the
24 contract was issued, a plat or diagram showing the location of termite or
25 other structural pest infestations, if present, location of damaged areas,
26 and an outline of the work to be carried out.
27 (4)(3) A report shall be filed each month even though if no work
28 is performed.
