17 SECURITY AGENCY, PRIVATE INVESTIGATOR,
18 AND SCHOOL SECURITY LICENSING AND
19 CREDENTIALING ACT.

22 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS:

24 SECTION 1. Arkansas Code 17-40-103(a), concerning exemptions to the
25 Private Security Agency, Private Investigator, and School Security Licensing
26 and Credentialing Act, is amended to add an additional subdivision to read as
27 follows:
28 (18)(A) Installation of a device that is on property owned or
29 leased by a person monitoring the device.
30 (B) As used in subdivision (18)(A) of this section,
31 "device" includes without limitation an electrical, electronic, or mechanical
32 alarm signal device, burglar alarm, television camera, or still camera used
33 to manually or automatically signal or detect a burglary, an act of breaking
34 and entering, shoplifting, pilferage, theft, a holdup, or other illegal or
35 unauthorized activity.
36 (C)(i) A technician who is installing a device as

1 described in subdivision (a)(18)(A) of this section is required to submit to
2 a state and national criminal background check to be conducted by the
3 Identification Bureau of the Division of Arkansas State Police and the
4 Federal Bureau of Investigation.
5 (ii) The state and national criminal background
6 check described in subdivision (a)(18)(C)(i) of this section shall:
7 (a) Conform to all applicable federal
8 standards; and
9 (b) Include the taking of fingerprints.
