23 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS:

25 SECTION 1. Arkansas Code 12-75-111(b) and (c), concerning the powers
26 and duties of the Division of Emergency Management, are amended to read as
27 follows:
28 (b)(1) The division Division of Emergency Management shall take an
29 integral part in the development and revision of local and
30 interjurisdictional emergency operations plans prepared under 12-75-118.
31 (2)(A) To meet the requirements of subdivision (b)(1) of this
32 section, the division Division of Emergency Management shall employ or
33 otherwise secure the services of professional and technical personnel capable
34 of providing expert assistance to political subdivisions, their local offices
35 of emergency management, interjurisdictional planning, and
36 interjurisdictional offices of emergency management.

1 (B) Personnel described in subdivision (b)(2)(A) of this
2 section shall consult with political subdivisions, local offices of emergency
3 management, and interjurisdictional offices of emergency management on a
4 regularly scheduled basis and shall make field examinations of the area,
5 circumstances, and conditions to which particular local and
6 interjurisdictional emergency operations plans are intended to apply and may
7 suggest or require revisions.
8 (c)(1) The division Division of Emergency Management shall administer
9 and operate the Arkansas Wireless Information Network.
10 (2) The division Division of Emergency Management shall perform
11 all functions necessary to maintain and operate the Arkansas Wireless
12 Information Network, including without limitation:
13 (A) Employ personnel;
14 (B) Manage, maintain, and acquire all equipment and
15 assets;
16 (C) Enter into contracts and lease agreements on behalf of
17 the Arkansas Wireless Information Network; and
18 (D) Administer the budget, expenditures, and all funding
19 of the Arkansas Wireless Information Network.
20 (d)(1) The Division of Emergency Management shall administer the
21 Arkansas Continuity of Operations Program.
22 (2) The Arkansas Continuity of Operations Program shall assist
23 state departments, boards, and commissions to:
24 (A) Develop an emergency operations plan;
25 (B) Maintain an emergency operations plan; and
26 (C) Test an emergency action plan.
27 (3) The Arkansas Continuity of Operations Program shall provide
28 or assist a state department, board, or commission with emergency operation
29 plan:
30 (A) Methodology;
31 (B) Hardware;
32 (C) Software;
33 (D) Training; and
34 (E) User assistance.
35 (4) The Division of Emergency Management may request the
36 assistance of the Division of Information Systems in reviewing technology
