17 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS:

19 SECTION 1. Arkansas Code 3-4-601, concerning the various kinds of
20 permits related to alcoholic beverages, is amended to add an additional
21 subdivision to read as follows:
22 (10) Beer direct shipper permit.

24 SECTION 2. Arkansas Code Title 3, Chapter 4, Subchapter 6, is amended
25 to add an additional section to read as follows:
26 3-4-612. Beer direct shipper permit.
27 (a)(1) An operator of a microbrewery may apply to the Director of the
28 Alcoholic Beverage Control Division for a beer direct shipper permit that
29 authorizes the beer direct shipper permit holder to ship beer directly to the
30 residence of a consumer of legal age in this state.
31 (2) A beer direct shipper permit holder may ship beer to the
32 residence of a consumer in another state if the other state allows alcohol to
33 be directly shipped to consumers.
34 (b) The beer direct shipper permit may be issued by the Alcoholic
35 Beverage Control Division to a qualified microbrewery.
36 (c) An operator of a microbrewery applying for a beer direct shipper

1 permit shall provide the division with a copy of the microbrewerys current
2 license to manufacture beer issued by:
3 (1) The state where the microbrewery is located; and
4 (2) The Alcohol and Tobacco Tax and Trade Bureau of the United
5 States Department of the Treasury.
6 (d)(1) A beer direct shipper permit shall be issued initially for a
7 fee of one hundred dollars ($100).
8 (2) A beer direct shipper permit shall expire on June 30 of each
9 year and may be renewed annually for a fee of fifty dollars ($50.00).
10 (e) A beer direct shipper permit holder shall collect and pay all
11 sales taxes and excise taxes due on a sale to a consumer as required under
12 state law.
13 (f) A beer direct shipper permit holder shall ensure that all
14 containers of beer shipped to and delivered within this state are
15 conspicuously labeled as follows:
16 CONTAINS ALCOHOL; SIGNATURE OF PERSON AGE 21 OR OLDER REQUIRED FOR
17 DELIVERY.
18 (g) A beer direct shipper permit holder shall arrange delivery of the
19 beer shipped to an Arkansas consumer only during the hours of the day that
20 alcoholic beverages may be purchased in the state.
