20 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS:

22 SECTION 1. Arkansas Code 6-18-1906(b)(1), concerning limitations on
23 school choice transfers under the Public School Choice Act of 2015, is
24 amended to add an additional subdivision to read as follows:
25 (D)(i) A student who has attended a public school licensed
26 early childhood program in a nonresident district for at least the entire
27 school year immediately prior to the school year in which the student intends
28 to enroll in kindergarten may continue attending in the nonresident district.
29 (ii) A student maintaining enrollment in a
30 nonresident district under subdivision (b)(1)(D)(i) of this section shall:
31 (a) Not count against the cap of three percent
32 (3%) of the resident or nonresident district under subdivision (b)(1)(A) of
33 this section; and
34 (b) Submit an application for a transfer as
35 required under 6-18-1905.
36 (iii) If a student under subdivision (b)(1)(D)(i) of

1 this section returns to his or her resident district or enrolls in a private
2 or home school, the:
3 (a) Transfer granted under subdivision
4 (b)(1)(D)(ii)(b) of this section shall be voided; and
5 (b) Student shall reapply for a future school
6 choice transfer as required under 6-18-1905.
