10 AND DECLARATION OF THE STATE OF ARKANSAS AS A
11 DISASTER AREA UNDER EXECUTIVE ORDER 20-37 AND
12 EXECUTIVE ORDER 21-03.

17 DISASTER EMERGENCY AND DECLARATION OF THE
18 STATE OF ARKANSAS AS A DISASTER AREA
19 UNDER EXECUTIVE ORDER 20-37 AND EXECUTIVE
20 ORDER 21-03.

23 WHEREAS, in Executive Order 20-03, issued on March 11, 2020, Governor
24 Asa Hutchinson declared an emergency in the State of Arkansas in response to
25 an outbreak of coronavirus 2019 (COVID-19); and
26
27 WHEREAS, Executive Order 20-13 declared the entire state of Arkansas an
28 emergency disaster area based upon the impact of coronavirus 2019 (COVID-19);
29 and
30
31 WHEREAS, Executive Order 20-37, issued on June 18, 2020, terminated the
32 emergency declared under Executive Order 20-03 and declared anew the public
33 health and disaster emergency and declaration of the State of Arkansas as a
34 disaster area; and
35
36 WHEREAS, Executive Order 20-45, issued on August 14, 2020, renewed the

1 emergency and disaster area declarations under Executive Order 20-37 for an
2 additional sixty (60) days; and

4 WHEREAS, Executive Order 20-48, issued on October 13, 2020, again
5 renewed the emergency and disaster area declarations under Executive Order
6 20-37 for sixty (60) additional days; and
7
8 WHEREAS, Executive Order 20-51, issued on December 11, 2020, renewed
9 the emergency and disaster area declarations previously renewed by Executive
10 Orders 20-45 and 20-48 for an additional twenty (20) days until December 31,
11 2020; and

13 WHEREAS, Executive Order 20-53, issued on December 29, 2020, renewed
14 the emergency and disaster area declarations under Executive Order 20-37 for
15 sixty (60) additional days; and
16
17 WHEREAS, Executive Order 21-03, issued on February 26, 2021, renewed
18 the emergency and disaster area declarations under Executive Order 20-37
19 until March 31, 2021, unless renewed in whole or in part by a subsequent
20 executive order; and
21
22 WHEREAS, Arkansas Code 12-75-107(c)(1) provides that the General
23 Assembly by concurrent resolution may terminate a state of disaster emergency
24 at any time,

26 NOW THEREFORE,
27 BE IT RESOLVED BY THE SENATE OF THE NINETY-THIRD GENERAL ASSEMBLY OF THE
28 STATE OF ARKANSAS, THE HOUSE OF REPRESENTATIVES CONCURRING THEREIN:

30 THAT the General Assembly hereby terminates the public health and
31 disaster emergency and declaration of the State of Arkansas as a disaster
32 area under Executive Order 20-37 and renewed by Executive Order 21-03.

34 BE IT FURTHER RESOLVED that the termination of the public health and
35 disaster emergency and declaration of the State of Arkansas as a disaster
36 area under Executive Order 20-37 and Executive Order 21-03 shall terminate

1 all executive orders issued in response to the emergency renewed under
2 Executive Order 21-03, including without limitation:
3 (1) Executive Order 20-05, regarding telehealth;
4 (2) Executive Order 20-06, extended by Executive Order 20-16,
5 regarding the suspension of rules and statutes by state agencies;
6 (3) Executive Order 20-14, regarding the suspension of in-person
7 witnessing and notarization of legal documents;
8 (4) Executive Order 20-15, regarding suspension of prohibitions
9 for banks and corporations to hold shareholder meetings solely or partially
10 by remote communication;
11 (5) Executive Order 20-18 and Executive Order 20-52, regarding
12 access to healthcare resources;
13 (6) Executive Order 20-22 and Executive Order 20-35, regarding
14 Workers' Compensation protections;
15 (7) Executive Order 20-33, regarding the protection of
16 businesses from liability related to coronavirus 2019 (COVID-19); and
17 (8) Executive Order 20-43, regarding the issuance of a face
18 covering directive by the Department of Health.
