11 DISASTER AREA UNDER EXECUTIVE ORDER 20-37 AND
12 EXECUTIVE ORDER 20-51.

17 DISASTER EMERGENCY AND DECLARATION OF THE
18 STATE OF ARKANSAS AS A DISASTER AREA
19 UNDER EXECUTIVE ORDER 20-37 AND EXECUTIVE
20 ORDER 20-51.

23 WHEREAS, in Executive Order 20-03, issued on March 11, 2020, Governor
24 Asa Hutchinson declared an emergency in the State of Arkansas in response to
25 an outbreak of coronavirus 2019 (COVID-19); and
26
27 WHEREAS, Executive Order 20-37, issued on June 18, 2020, terminated the
28 emergency declared under Executive Order 20-03 and declared anew the public
29 health and disaster emergency and declaration of the State of Arkansas as a
30 disaster area; and
31
32 WHEREAS, Executive Order 20-45, issued on August 14, 2020, renewed the
33 emergency declared under Executive Order 20-37 for an additional sixty (60)
34 days; and
35
36 WHEREAS, Executive Order 20-48, issued on October 13, 2020, again

1 renewed the emergency declared by Executive Order 20-37 for sixty (60)
2 additional days; and

4 WHEREAS, Executive Order 20-51, issued on December 11, 2020, renewed
5 the emergency previously renewed by Executive Orders 20-45 and 20-48 for an
6 additional twenty (20) days until December 31, 2020, unless the emergency is
7 renewed in whole or in part by a subsequent executive order; and
8
9 WHEREAS, Arkansas Code 12-75-107(c)(1) provides that the General
10 Assembly by concurrent resolution may terminate a state of disaster emergency
11 at any time,

13 NOW THEREFORE,
14 BE IT RESOLVED BY THE HOUSE OF REPRESENTATIVES OF THE NINETY-THIRD GENERAL
15 ASSEMBLY OF THE STATE OF ARKANSAS, THE SENATE CONCURRING THEREIN:
16
17 THAT the General Assembly hereby terminates the public health and
18 disaster emergency and declaration of the State of Arkansas as a disaster
19 area under Executive Order 20-37 and renewed by Executive Order 20-51.

21 BE IT FURTHER RESOLVED that the termination of the public health and
22 disaster emergency and declaration of the State of Arkansas as a disaster
23 area under Executive Order 20-37 and Executive Order 20-51 shall terminate
24 all executive orders issued in response to the emergency renewed under
25 Executive Order 20-51, including without limitation:
26 (1) Executive Order 20-05, regarding telehealth;
27 (2) Executive Order 20-06, extended by Executive Order 20-16,
28 regarding the suspension of rules and statutes by state agencies;
29 (3) Executive Order 20-14, regarding the suspension of in-person
30 witnessing and notarization of legal documents;
31 (4) Executive Order 20-15, regarding suspension of prohibitions
32 for banks and corporations to hold shareholder meetings solely or partially
33 by remote communication;
34 (5) Executive Order 20-18 and Executive Order 20-34, regarding
35 access to healthcare resources;
36 (6) Executive Order 20-22 and Executive Order 20-35, regarding

1 Workers' Compensation protections;
2 (7) Executive Order 20-33, regarding the protection of
3 businesses from liability related to coronavirus 2019 (COVID-19); and
4 (8) Executive Order 20-43, regarding the issuance of a face
5 covering directive by the Department of Health.
