18 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS:

20 SECTION 1. Arkansas Code Title 1, Chapter 1, Subchapter 1, is amended
21 to add an additional section to read as follows:
22 1-1-104. Daylight Saving Time Intent to adopt permanently when
23 permitted by federal law.
24 (a) The General Assembly intends to adopt Daylight Saving Time as the
25 permanent standard time of the State of Arkansas when the United States
26 Government allows states to observe Daylight Saving Time permanently under 15
27 U.S.C. 260a.
28 (b)(1) The Secretary of State shall continually monitor action by the:
29 (A) United States Government and shall determine whether
30 15 U.S.C. 260a has been amended to allow states to observe Daylight Saving
31 Time permanently; and
32 (B) States that border Arkansas and shall determine
33 whether each of the bordering states has declared its intention to adopt
34 Daylight Saving Time permanently.
35 (2) If the Secretary of State determines that 15 U.S.C. 260a
36 has been amended to allow states to observe Daylight Saving Time permanently

1 and that all of the states that border Arkansas have declared their intention
2 to adopt Daylight Saving Time permanently:
3 (A) The Secretary of State shall inform the Governor, the
4 Speaker of the House of Representatives, the President Pro Tempore of the
5 Senate, and the Director of the Bureau of Legislative Research within five
6 (5) business days of making the determinations required under subdivision
7 (b)(1) of this section; and
8 (B)(i) The state shall observe Daylight Saving Time
9 permanently as the standard time in the State of Arkansas.
10 (ii) If the determinations required under
11 subdivision (b)(1) of this section are made on or after the second Sunday in
12 March and before the first Sunday in November, the standard time of the state
13 shall not change in November, and Daylight Saving Time is adopted permanently
14 in the state.
15 (iii) If the determinations required under
16 subdivision (b)(1) of this section are made on or after the first Sunday in
17 November and before the second Sunday in March, at 2:00 antemeridian on the
18 second Sunday of March following the determinations required under
19 subdivision (b)(1) of this section, the standard time of the State of
20 Arkansas shall be advanced one (1) hour and remain there permanently.
