Existing law protects the rights of unborn children in certain circumstances. The Alabama Supreme Court has held that "extrauterine children," that is, unborn children "located outside of a biological uterus," are considered unborn children for purposes of the Wrongful Death of a Minor Act. This bill would provide that any fertilized human egg or human embryo that exists outside of a human uterus is not considered an unborn child or human being for any purpose under state law.
