This bill amends Section 28-11-13 of the Code of Alabama to further prohibit individuals under the age of 21 from purchasing, using, possessing, or transporting tobacco, tobacco products, electronic nicotine delivery systems, or alternative nicotine products. The bill adds language to include other electronic battery-powered devices capable of delivering e-liquid, tobacco, CBD oil, THC oil, herbal extract, nicotine salt, or any other substance through inhalation of vapor. The possession of an electronic nicotine delivery system is considered a violation, regardless of whether it is used with any other substance. The bill also makes it unlawful for individuals under 21 to present false identification to obtain tobacco or nicotine products. If a minor is cited for a violation, the citing agency is required to make reasonable efforts to notify a parent, legal guardian, or legal custodian of the minor.

This bill does not require any new or increased expenditure of local funds. It defines a new crime and amends the definition of an existing crime. The bill will become effective on the first day of the third month following its passage and approval by the Governor or its otherwise becoming law.
