This bill, relating to Coffee and Pike Counties and the Twelfth Judicial Circuit, amends Section 45-16-82.27 of the Code of Alabama 1975. The bill provides for fees related to the pretrial diversion program. It allows for the assessment of a fee when an applicant is approved for the program, in addition to any court costs and assessments for victims or treatment required by law. The bill also establishes different fees for different offenses, with felony offenses being subject to a fee of up to $2,000, driving under the influence offenses subject to a fee of up to $2,100, misdemeanor offenses subject to a fee of up to $1,000, traffic offenses subject to a fee of up to $450, and violations subject to a fee of up to $350. The bill also allocates a portion of the fees to the Coffee County Circuit Clerk's Office, the Pike County Circuit Clerk's Office, the Coffee County General Fund, the Pike County General Fund, and the arresting or ticketing law enforcement agency. The bill allows the district attorney to use the fees collected to fund the pretrial diversion program, prosecute state criminal cases, support law enforcement and coroners, and benefit any agency or department of state, city, or county government that assists local law enforcement. The bill also allows the district attorney to raise fees to meet those prescribed by the Alabama Legislature if a state pretrial diversion program is enacted. The bill becomes effective on the first day of the third month following its passage and approval by the Governor.
