This bill, HB40, makes changes to the law regarding retired justices and judges in Alabama who are called back into service. It specifies that retired justices or judges who are called to active duty status will receive per diem expenses and mileage, as well as court-supportive personnel. They will also be required to complete continuing legal education annually. The bill also gives the Chief Justice and the presiding circuit judge the authority to determine if a retired justice or judge is satisfactorily performing their duties, and if not, they will be removed from active duty status.

Additionally, the bill states that retired judges will hold office as additional or extra judges and may only be removed for specified causes. Retired judges may be transferred to inactive status upon request and will be entitled to the same retirement benefits. The Administrative Office of Courts will establish policies and procedures for nominations and duties assigned to interim active duty status judges. The bill will become effective on the first day of the third month following its passage and approval by the Governor.
