8 SYNOPSIS: Act 2022-133 of the 2022 Regular Session
9 amended the definition of a shotgun, to remove the
10 criterion that the firearm be intended to be fired
11 from the shoulder.
12 This bill would revise the definition of a
13 shotgun, to restore the criterion that the firearm
14 be intended to be fired from the shoulder, and to
15 restore the criterion that the firearm be made to
16 fire a number of ball shot or a single projectile
17 for each pull of the trigger.

23 Relating to firearms; to amend Section 13A-11-62,
24 Code of Alabama 1975, as amended by Section 1 of Act 2022-133,
25 2022 Regular Session, to revise the definition of shotgun.
26 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:

1 Section 1. Section 13A-11-62, Code of Alabama 1975,
2 as amended by Section 1 of Act 2022-133, 2022 Regular Session,
3 is amended to read as follows:
4 "13A-11-62.
5 "For purposes of this division, the following terms
6 shall have the following meanings, unless the context clearly
7 indicates otherwise:
8 "(1) FIREARM. As defined under Section 13A-8-1.
9 "(2) RIFLE. Any weapon designed or redesigned, made
10 or remade, and intended to be fired from the shoulder and
11 designed or redesigned and made or remade to use the energy of
12 the explosive in a fixed metallic cartridge to fire only a
13 single projectile through a rifled bore for each pull of the
14 trigger.
15 "(3) SHORT-BARRELED RIFLE. A rifle having one or
16 more barrels less than 16 inches in length and any weapon made
17 from a rifle (whether by alteration, modification, or
18 otherwise) if such weapon, as modified, has an overall length
19 of less than 26 inches.
20 "(4) SHORT-BARRELED SHOTGUN. A shotgun having one or
21 more barrels less than 18 inches in length and any weapon made
22 from a shotgun (whether by alteration, modification, or
23 otherwise) if such weapon as modified has an overall length of
24 less than 26 inches.
25 "(5) SHOTGUN. A weapon designed or redesigned, made
26 or remade, and intended to be fired from the shoulder and
27 designed or redesigned and made or remade to use the energy of

1 the explosive in a fixed shotgun shell to fire through a
2 smooth bore either a number of ball shot or a single
3 projectile for each single pull of the trigger."
4 Section 2. This act shall become effective on
5 January 1, 2023, following its passage and approval by the
6 Governor, or its otherwise becoming law.
