4 ENROLLED, An Act,
5 Relating to firearms; to provide prohibitions on the
6 enforcement of certain presidential executive orders which
7 provide certain limitations or restrictions on the ownership,
8 use, or possession of firearms and accessories and ammunition
9 thereof.
10 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
11 Section 1. (a) This section shall be known and may
12 be cited as the Alabama Second Amendment Protection Act.
13 (b) Notwithstanding any provision of law to the
14 contrary, an official, officer, employee, or agent of the
15 state or political subdivision thereof, when acting in an
16 official capacity, may not enforce or administer any executive
17 order issued by the President of the United States which
18 limits or restricts the ownership, use, or possession of
19 firearms, ammunition, or firearm accessories by law-abiding
20 residents of the state. An official, officer, employee, or
21 agent of the state or political subdivision thereof, when
22 acting in an official capacity, shall not be ordered,
23 directed, or compelled to execute or administer the executive
24 order.

1 (c) No state or local public funds may be expended
2 for the enforcement of any executive order issued by the
3 President of the United States which limits or restricts the
4 ownership, use, or possession of firearms, ammunition, or
5 firearm accessories by law-abiding residents of the state, as
6 described in subsection (b).
7 (d) The Attorney General may issue guidance to state
8 and local officials to ensure uniform compliance with this
9 section.
10 Section 2. This act shall become effective on the
11 first day of the third month following its passage and
12 approval by the Governor, or its otherwise becoming law.
