11 AN ACT

13 Relating to Jefferson County; to establish the
14 Jefferson County Citizens Health Advisory Board; to provide
15 for its membership and duties; and to require the Jefferson
16 County Health Officer to consider the recommendations of the
17 Jefferson County Citizens Health Advisory Board before issuing
18 any countywide resolution, order, or directive that has the
19 effect of closing businesses.
20 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
21 Section 1. (a) The Jefferson County Citizens Health
22 Advisory Board is created. Members of the advisory board shall
23 be appointed as follows:
24 (1) One member appointed by the Birmingham City
25 Council.
26 (2) One member appointed by the Jefferson County
27 Commission.

1 (3) One member appointed by the Jefferson County
2 Mayors Association.
3 (4) One superintendent in Jefferson County appointed
4 by those superintendents in the School Superintendents of
5 Alabama District 5 who serve school districts located in
6 Jefferson County.
7 (5) One member appointed by the Birmingham Business
8 Alliance.
9 (b) Members of the advisory board must be residents
10 of Jefferson County. The appointing authorities shall
11 coordinate appointments to reflect the diversity of gender,
12 race, and geographical areas that make up the county.
13 (c) Members' terms shall be for four years, except
14 initial terms shall be staggered, as determined by the county
15 commission. Any vacancy on the advisory board shall be filled
16 by the respective appointing authority.
17 (d) Before issuing any resolution, order, or other
18 directive encouraging or mandating countywide compliance which
19 effects the closure of businesses, the Jefferson County Health
20 Officer shall submit a copy of the proposed resolution, order,
21 or directive to the advisory board along with a written
22 request for recommendations of the advisory board regarding
23 the subject and content of the resolution, order, or
24 directive. The Jefferson County Health Officer may not issue
25 the resolution, order, or directive until after he or she
26 receives and considers any recommendations from the advisory

1 board, provided the advisory board responds within 48 hours of
2 receiving the health officer's written request.
3 (e) Nothing in this section shall prohibit the
4 Jefferson County Board of Health to continue to operate under
5 the supervision and control of the State Board of Health.
6 Section 2. This act shall become effective on the
7 first day of the third month following its passage and
8 approval by the Governor, or its otherwise becoming law.
