4 ENROLLED, An Act,
5 Relating to Mobile County; to amend Section
6 45-49-151.07, Code of Alabama 1975, relating to the Mobile
7 County Racing Commission; to provide that any person,
8 association, or corporation desiring to operate a racetrack in
9 the county may hold and conduct one or more race meetings at
10 the track each year; to provide that the licensee authorized
11 to conduct race meetings under this act may receive broadcasts
12 of events conducted outside of Mobile County and allow all
13 forms of pari-mutuel wagering on those events; to provide that
14 the gross proceeds retained by the licensee on all wagering
15 received under this section shall be subject to a commission
16 of two percent to be paid by the licensee to the racing
17 commission; and to further define the term "broadcast" to
18 include digital transmission or exhibition of historical
19 races.
20 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
21 Section 1. Section 45-49-151.07, Code of Alabama
22 1975, is amended to read as follows:
23 "45-49-151.07.
24 "(a) Any person, association, or corporation
25 desiring to operate a racetrack in the county shall may hold

1 and conduct one or more race meetings at the track each year,
2 but no license shall be granted to any person, association, or
3 corporation, or to any track for a period longer than 312
4 racing days in any one year.
5 "(b)(1) Any licensee conducting authorized to
6 conduct race meetings under this subpart may:
7 "a. Receive broadcasts of horse races and dog races
8 pari-mutuel events conducted outside of Mobile County, and
9 allow all forms of pari-mutuel wagering on those races events.
10 The gross proceeds retained by the licensee on all wagering by
11 patrons on horse races or dog races received under this
12 section shall be subject to a commission of two percent to be
13 paid by the licensee to the racing commission.
14 "b. Transmit broadcasts of dog races to tracks
15 located outside of Mobile County and to other authorized
16 facilities located outside of the State of Alabama. The gross
17 proceeds retained by the licensee on all wagering by patrons
18 on dog races broadcast under this section shall be subject to
19 the same percentage commissions as are paid by the licensee to
20 the racing commission on receiving broadcasts.
21 "(2) For the purposes of this section, the term
22 broadcast means the broadcast, transmission, or exhibition in
23 any medium or manner by means which may include, but are not
24 limited to, digital transmission or exhibition of historical
25 races; community antenna systems which receive and retransmit

1 television or radio signals by wire, cable, or otherwise to
2 television or radio sets; and cable origination networks or
3 programmers which transmit programming to community antenna
4 television or closed-circuit systems by wire, cable,
5 satellite, or otherwise.
6 "(3) To the extent that any rights, privileges, or
7 immunities granted to racing associations under this section
8 conflict with this subpart or any other law or affect any
9 order or rule of the Alabama Public Service Commission
10 relating to the regulation of public utilities and the
11 furnishing of any communication, wire service, or other
12 similar service or equipment, the rights, privileges, or
13 immunities granted under this section will prevail over the
14 conflicting provisions.
15 "(4) The racing commission may establish necessary
16 rules and regulations for the reasonable regulation of the
17 broadcast races."
18 Section 2. This act shall become effective
19 immediately following its passage and approval by the
20 Governor, or its otherwise becoming law.
