2 ENROLLED, An Act,
3 Relating to Lowndes County; to provide that the
4 county health department's Public Health Environmental Soil
5 Specialist shall perform site evaluation tests upon request
6 before the installation of a conventional onsite disposal
7 septic system or repair of such existing system.
8 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
9 Section 1. In Lowndes County, notwithstanding all
10 laws, rules, and regulations to the contrary, upon request by
11 a property owner, the County Health Department's Public Health
12 Environmental Soil Specialist, or its duly appointed agent,
13 shall perform a site evaluation test prior to the installation
14 or repair of a conventional onsite disposal septic system at
15 no cost the homeowner. However, if Lowndes County becomes a
16 "fee-based county" a site evaluation fee of not more than
17 fifty dollars ($50) shall be paid to the Lowndes County Health
18 Department.
19 Section 2. This act shall become effective
20 immediately following its passage and approval by the
21 Governor, or its otherwise becoming law.
