2 ENROLLED, An Act,
3 Relating to Montgomery County, Alabama, and
4 particularly to the Pike Road School Tax District (the area
5 within the City of Pike Road, Alabama) in said County; to
6 provide for the levy in said District of an additional 25.5
7 mills of ad valorem school district taxation effective
8 simultaneously with the expiration of 6.5 mills of a separate
9 ad valorem school district tax, so as to produce a net
10 increase of 19 mills of ad valorem school district taxation in
11 said District, subject to approval of the levy of said
12 additional school district taxation by a majority of the
13 qualified electors of said District voting at a special
14 election to be held in said District therefor pursuant to the
15 laws governing special elections.
16 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
17 Section 1. For purposes hereof:
18 (1) Additional Pike Road School District Taxation
19 means the levy and collection in the Pike Road School Tax
20 District of additional ad valorem school district taxation at
21 the uniform rate of 3 mills pursuant to Amendment No. 3 to the
22 Alabama Constitution, as increased by 22.5 mills pursuant to
23 Section 217 of the Alabama Constitution to a uniform total
24 rate of 25.5 mills, effective simultaneously with the
25 reduction of 6.5 mills of ad valorem school district taxation

1 in said District (by expiration of a separate ad valorem
2 school tax therein) so as to produce a net increase of 19
3 mills of ad valorem school district taxation in said District,
4 and for any tax year for which the levy of said additional
5 school district tax at said uniform total rate shall be
6 approved in the manner then provided by law; provided that the
7 Additional Pike Road School District Taxation to be levied and
8 collected in the district may be levied commencing with the
9 tax year commencing on October 1, 2022, to be collected for
10 the year for which district school taxes become due and
11 payable on October 1, 2023, and thereafter, notwithstanding
12 any other provision of this subdivision; provided further,
13 that the net proceeds of the Additional Pike Road School
14 District Taxation shall be used exclusively for capital outlay
15 purposes to acquire, equip, design, construct, finance,
16 maintain, and repair public school facilities in the Pike Road
17 School District, and for the payment of the principal and
18 interest on indebtedness for those purposes.
19 (2) Alabama Constitution means the Constitution of
20 Alabama of 1901, as amended.
21 (3) Favorable Majority Vote means the approval of
22 the Additional Pike Road School District Taxation by a
23 majority of the qualified electors of the Pike Road School Tax
24 District who vote at a special election to be held in the Pike

1 Road School Tax District therefor pursuant to the laws
2 governing special elections.
3 (4) Pike Road School Tax District means and includes
4 the area within the corporate limits of the City of Pike Road,
5 Alabama.
6 (5) Proposal of Taxing Authority means the proposal
7 of the Additional Pike Road School District Taxation by the
8 Montgomery County Commission, as the taxing authority with
9 respect thereto, by resolution and order adopted upon request
10 of the City Board of Education of the City of Pike Road,
11 Alabama.
12 Section 2. The Legislature of Alabama, for purposes
13 of Section 217 of the Alabama Constitution and upon adoption
14 of the Proposal of the Taxing Authority, approves the
15 Additional Pike Road School District Taxation subject to the
16 Favorable Majority Vote.
17 Section 3. The Pike Road Superintendent of
18 Education, after approval of the Pike Road Board of Education,
19 shall submit the strategic plan and performance metrics of the
20 Pike Road Board of Education to the Montgomery County
21 Legislative Delagation all members of the State Senate and
22 House of Representatives that represent any part of Montgomery
23 County for review prior to commencement of the next Regular
24 Session of the Legislature. Thereafter, the Pike Road Board of
25 Education shall annually review and update the strategic plan

1 and the performance metrics as needed, and the Pike Road
2 Superintendent of Education shall submit the revised strategic
3 plan and performance metrics to the Montgomery County
4 Legislative Delegation all members of the State Senate and
5 House of Representatives that represent any part of Montgomery
6 County for review prior to each Regular Session of the
7 Legislature.
8 Section 4. The provisions of this act are severable.
9 If any part of this act is declared invalid or
10 unconstitutional, such declaration will not operate or be
11 construed to affect the validity or constitutionality of any
12 other part or provision hereof.
13 Section 5. This act shall become effective
14 immediately upon its passage and approval by the Governor, or
15 upon its otherwise becoming law.
