2 ENROLLED, An Act,
3 Relating to Clay County; creating the Clay County
4 Animal Shelter Authority and providing for the composition,
5 terms, duties, and powers of the authority.
6 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
7 Section 1. There is hereby created the Clay County
8 Animal Shelter Authority in the county for the purpose of
9 providing animal control shelter services for dogs and cats in
10 Clay County. For the purposes of this act, the term "animal
11 control shelter services" means the control, removal, and
12 containment of stray, at-large, or surrendered dogs and cats.
13 Section 2. (a) The authority shall be governed by a
14 board of directors consisting of 10 members, who shall be
15 residents of Clay County. Each member of the Clay County
16 Commission shall appoint one of the members; each member of
17 the legislative delegation serving Clay County shall appoint a
18 member; and the mayor of the City of Ashland and the mayor of
19 the City of Lineville shall each appoint one member.
20 Subsequently, vacancies on the board shall be appointed by the
21 same appointing authority who made the initial appointment.
22 (b) The initial terms of the directors shall be
23 staggered, three shall be for a term of two years, three shall
24 be for a term of three years, and four shall be for a term of
25 four years.

1 (c) Within 30 days following the effective date of
2 this act, the appointing authorities shall submit in writing
3 the name and address of the members of the board of directors
4 to the judge of probate and the appointments shall be filed
5 and maintained in the Office of the Judge of Probate of Clay
6 County. At the organization meeting of the members of the
7 board of directors, members shall select by lot the initial
8 term for which each shall serve. The terms shall also be filed
9 with the judge of probate. The members shall also elect from
10 among the members, a President, Vice President, Secretary, and
11 Treasurer. Each shall serve a period of one year, or until a
12 successor is elected and qualified. The members shall not be
13 bonded, except the treasurer, who shall obtain a bond. The
14 terms of all members, subsequent to the initial terms, shall
15 be four years. Members shall not serve more than two four-year
16 terms.
17 Section 3. The authority may enter into contracts
18 with governmental agencies or public or private entities for
19 the operation and maintenance of a county pound or animal
20 shelter. The authority shall have the power to solicit and
21 receive contributions, donations, and grants of money,
22 equipment, supplies, and services from other government
23 entities, corporations, partnerships, or individuals. All
24 contributions, donations, and grants, including any money set
25 aside for or appropriated to the authority by the county

1 commission or the Legislature, shall be used solely to provide
2 animal control shelter services in Clay County.
3 Section 4. This act shall become effective
4 immediately upon its passage and approval by the Governor, or
5 upon its otherwise becoming a law.
