6 ENROLLED, An Act,
7 Relating to Cleburne County; to provide for the
8 qualifications of the sheriff; and to require completion of
9 continuing education.
10 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
11 Section 1. This act shall only apply in Cleburne
12 County.
13 Section 2. On or after the effective date of this
14 act, an individual qualifying for election to the office of
15 sheriff in the county or any individual appointed to serve as
16 a sheriff shall meet all of the following minimum
17 qualifications, in addition to any other qualifications
18 required by law:
19 (1) Is a citizen of the United States.
20 (2) Has been a resident of the county for at least
21 one year immediately prior to the qualification date.
22 (3) Has the qualifications of an elector pursuant to
23 state and federal law and the individual has been registered
24 to vote in the county at least one year immediately prior to
25 qualifying.

1 (4) Has been awarded a high school diploma or a GED
2 equivalent.
3 (5) Is 25 years of age or older prior to qualifying.
4 (6) The individual has three or more years of
5 full-time prior service as a law enforcement officer having
6 the power of arrest, which service is certified by the Alabama
7 Peace Officers' Standards and Training Commission.
8 (7) Either of the following:
9 a. Has not been retired or separated from full-time
10 active law enforcement certified through the Alabama Peace
11 Officers' Standards and Training Commission for more than two
12 consecutive years from the date of qualifying.
13 b. In the event the individual has been retired or
14 separated from active law enforcement for more than two
15 consecutive years, the individual has obtained a
16 re-certification of full-time active law enforcement status as
17 a law enforcement officer from the Alabama Peace Officers'
18 Standards and Training Commission prior to the date of
19 qualifying.
20 (8) The individual has never been convicted of a
21 felony criminal offense in this state or convicted of a
22 criminal offense in another jurisdiction where a conviction of
23 the offense would be considered a felony offense in this
24 state.

1 Section 3. Upon election, the sheriff of the county
2 shall attend annually a minimum of 20 hours of executive level
3 continuing education approved by the Alabama Sheriff's
4 Association, National Sheriff's Association, or any other
5 recognized executive level continuing education program
6 designed for law enforcement.
7 Section 4. This act shall become effective
8 immediately following its passage and approval by the
9 Governor, or its otherwise becoming law.
