2 ENROLLED, An Act,
3 To amend Section 34-21A-10, Code of Alabama 1975,
4 relating to the Alabama Onsite Wastewater Board; to exempt
5 certain distributors, owners of multiple wastewater systems,
6 and general contractors from licensure or regulation by the
7 board.
8 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
9 Section 1. Section 34-21A-10 of the Code of Alabama
10 1975, is amended to read as follows:
11 "34-21A-10.
12 "(a) The licensing requirements of this chapter
13 shall not apply to owners of property for the purpose of
14 installing, cleaning, servicing, or maintaining an onsite
15 sewage system on their own property with a one-family or
16 two-family residence used as their primary residence so long
17 as the owners of the property with an onsite sewage system
18 complete all installation, cleaning, servicing, or maintenance
19 themselves, without help, at their primary residence.
20 "(b) The board shall not license or regulate any of
21 the following:
22 "(1) An individual or entity that distributes septic
23 tanks or conventional or engineered onsite sewage systems or
24 onsite wastewater systems.

1 "(2) An owner of multiple wastewater systems, or a
2 system that is part of a group of wastewater systems under
3 common ownership, with one or more of those systems having a
4 design flow of 15,000 GPD or greater.
5 "(3) A general contractor licensed by the State
6 Licensing Board for General Contractors, with a municipal and
7 utility endorsement, while installing or maintaining
8 wastewater systems as described in subdivision (2)."
9 Section 2. This act shall become effective on the
10 first day of the third month following its passage and
11 approval by the Governor, or its otherwise becoming law.
