13 Relating to Sumter County; to provide for the manner
14 of selection of the chair and vice-chair of the county
15 commission; to provide for the compensation of the chair and
16 vice-chair; and to repeal Section 2 of Act 176 of the 1973
17 Regular Session (Acts 1973, p. 217), as amended.
18 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
19 Section 1. This act shall only apply in Sumter
20 County.
21 Section 2. Beginning the first November following
22 the effective date of this act, the county commission shall
23 select its chair and its vice-chair by majority vote during
24 the organizational meeting required by Section 11-3-1(e), Code
25 of Alabama 1975, or, for any year during which no election for
26 county commission takes place, the county commission shall

1 select its chair and its vice-chair by majority vote during
2 the first meeting in November.
3 Section 3. (a)(1) Beginning on the first day of the
4 first month after the effective date of this act, the annual
5 expense allowance of the chair shall be an amount so that the
6 salary of the chair and expense allowance of the chair equals
7 80 percent of the annual compensation paid to the Judge of
8 Probate of Sumter County in the preceding fiscal year ending
9 on September 30, including any compensation increase provided
10 to the Judge of Probate by law. The expense allowance provided
11 in this subdivision shall be in addition to any salary
12 provided to the chair of the county commission by law.
13 (2) Beginning on the first day of the first month
14 after the effective date of this act, the monthly expense
15 allowance of the vice-chair of the county commission shall be
16 in the amount of two hundred fifty dollars ($250) per month,
17 to be paid on a monthly basis from the county general fund.
18 (b)(1) Effective beginning the next term of office
19 for the county commission, the annual salary of the chair
20 shall be an amount equal to 80 percent of the annual
21 compensation paid to the judge of probate of Sumter County in
22 the fiscal year ending on September 30 prior to the
23 organizational meeting required by Section 11-3-1(e), Code of
24 Alabama 1975, including any compensation increase provided to
25 the Judge of Probate by law. The salary provided by this
26 subdivision shall be in lieu of any other salary provided by
27 law to the chair as a member of the county commission.

1 (2) Effective beginning the next term of office for
2 the county commission, the annual salary of the vice-chair
3 shall be increased by monthly payments from the county general
4 fund in the amount of two hundred fifty dollars ($250) per
5 month. This monthly amount shall be in addition to any other
6 salary provided by law.
7 Section 4. Section 2 of Act 176 of the 1973 Regular
8 Session (Acts 1973, p. 217), as amended by Act 80-39 of the
9 1980 Regular Session (Acts 1980, p. 50) and Act 84-557 of the
10 1984 Regular Session (Acts 1984, p. 1179), is repealed. All
11 other laws or parts of laws which conflict with this act are
12 repealed.
13 Section 5. This act shall become effective on the
14 first day of the third month following its passage and
15 approval by the Governor, or its otherwise becoming law.
