2 ENROLLED, House Joint Resolution,
3 EXPRESSING OPPOSITION TO A FEDERAL REQUIREMENT THAT
4 THE STATE PASS A LAW REQUIRING REVOCATION OR SUSPENSION OF AN
5 INDIVIDUAL'S DRIVER'S LICENSE.

7 WHEREAS, 23 U.S.C. 159 requires states to enact
8 legislation mandating the revocation or suspension of an
9 individual's driver's license for at least six months upon
10 conviction of any drug-related offense; and
11 WHEREAS, 23 U.S.C. 159 requires withholding eight
12 percent of certain federal aid from states that fail to enact
13 this legislation; and
14 WHEREAS, the federal government should not dictate
15 policy or legislation of this kind for the state; and
16 WHEREAS, for Alabama to be exempt from this federal
17 requirement, the Governor must submit to the United States
18 Secretary of Transportation a written certification that she
19 is opposed to the enactment or enforcement of a law related to
20 the suspension or revocation of an individual's driver's
21 license for any drug-related offense and submit a written
22 certification that the Alabama Legislature has adopted a
23 resolution expressing opposition to the federal requirement;

1 WHEREAS, the State of Alabama should enforce its own
2 driver's license law, and it is the intent of the Legislature
3 that Alabama amend its law requiring the suspension or
4 revocation of a driver's license for certain drug-related
5 convictions if the violation did not involve a motor vehicle
6 to remove this requirement; now therefore,
7 BE IT RESOLVED BY THE LEGISLATURE OF ALABAMA, BOTH
8 HOUSES THEREOF CONCURRING, That this body declares its
9 opposition to the enactment or enforcement of a federal law
10 mandating, in all circumstances, the revocation or suspension
11 of an individual's driver's license upon conviction of any
12 drug-related offense.
13 BE IT FURTHER RESOLVED, That the Legislature
14 declares the state's determination to enforce its own law on
15 the subject, which provides that an individual convicted of
16 certain drug-related offenses will not have his or her
17 driver's license revoked or suspended if the violation did not
18 involve a motor vehicle.
19 BE IT FURTHER RESOLVED, That the Governor is
20 strongly urged to submit a written certification to the United
21 States Secretary of Transportation stating her opposition to
22 the enforcement of 23 U.S.C. 159.
23 BE IT FURTHER RESOLVED, That a copy of this
24 resolution be delivered to the Governor so that the strong
25 sentiments of this body may be known and that the Governor
