2 ENROLLED, An Act,
3 To amend Section 34-30-57, Code of Alabama 1975,
4 relating to the duties of the Alabama Board of Social Work
5 Examiners; to authorize the board to charge and collect fees
6 for verifying the existence of a current license, reactivating
7 an inactive license, reinstating a lapsed license, making
8 application to act as a continuing education provider, and
9 registering a supervisor; to provide for exemptions; and to
10 make technical corrections to reflect changes in license
11 names.
12 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
13 Section 1. Section 34-30-57 of the Code of Alabama
14 1975, is amended to read as follows:
15 "34-30-57.
16 "In addition to the duties set forth elsewhere in
17 this chapter, the Board of Social Work Examiners shall do all
18 of the following:
19 "(1) Recommend modifications and amendments to this
20 chapter.
21 "(2) Recommend to the appropriate district attorneys
22 prosecutions for the violations of this chapter, after and
23 only after the alleged violator has been notified of such
24 violation or violations and having been given 90 days to
25 disclaim, amend, and rectify such allegation.

1 "(3) Annually publish a list of the names and
2 addresses of all persons who are:
3 "a. "Licensed bachelor social workers," "licensed
4 graduate master social workers," and "licensed certified
5 independent clinical social workers" under this chapter.
6 "b. Eligible to engage in the private independent
7 practice of social work under this chapter.
8 "(4) Establish fees for initial examination,
9 licensure, certification, and renewal thereof; fees for
10 verifying the existence of a current license, reactivating an
11 inactive license, and reinstating a lapsed license; fees for
12 making application to the board to act as a continuing
13 education provider; and fees for registering a supervisor.
14 Nothing in this subdivision shall be interpreted as
15 requiring a state agency to pay any fees for the purposes of
16 verifying the licensure status of current or prospective
17 employees, registering any employee as a supervisor, or
18 providing continuing education to current or prospective
19 employees.
20 "(5) Establish requirements and standards for
21 continuing education. In establishing such requirements, the
22 board shall consult with those groups and organizations which
23 represent both the levels of practice specified in this
24 chapter and the various settings in which social work is
25 practiced. Furthermore, in developing such requirements, the

1 board shall consider, but shall not be limited in its
2 consideration to, agency recognized staff development programs
3 under the auspices of public agencies, continuing education
4 programs offered by colleges and universities having social
5 work programs approved or accredited by the Council on Social
6 Work Education, and continuing education programs offered by
7 recognized state and national social work bodies.
8 "(6) Promulgate Adopt rules and regulations pursuant
9 to the State Alabama Administrative Procedures Statute
10 Procedure Act that set forth professional standards for
11 "licensed bachelor social workers," "licensed graduate master
12 social workers," and "licensed certified independent clinical
13 social workers" who are certified for the private independent
14 practice of social work. Those proposed rules and regulations
15 shall be published at least 30 days prior to before the public
16 hearing relative to the proposed rules and regulations, and at
17 least 15 days in advance of such before the hearing, the board
18 shall publish notice of the date, time, and place where such
19 the public hearings of the board will shall be held for the
20 purpose of adopting or amending rules and regulations
21 pertaining to this chapter."
22 Section 2. This act shall become effective
23 immediately following its passage and approval by the
24 Governor, or its otherwise becoming law.
