2 ENROLLED, An Act,
3 Relating to the State Board of Registration for
4 Foresters; to amend Section 34-12-36, Code of Alabama 1975, to
5 provide for the sale of the nominal marketing or promotional
6 items by the board; and to provide for the deposit and use of
7 the funds received from the sale.
8 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
9 Section 1. Section 34-12-36, Code of Alabama 1975,
10 is amended to read as follows:
11 "34-12-36.
12 "(a) The secretary of the board shall receive and
13 account for all moneys derived under the provisions of this
14 chapter and shall pay the same monthly to the State Treasurer,
15 who shall keep such moneys in a separate fund to be known as
16 the "Professional Foresters Fund." Such fund shall be kept
17 separate and apart from all other moneys in the Treasury and
18 shall be paid out only by warrant of the Comptroller upon the
19 State Treasurer, upon itemized vouchers approved by the
20 chairman and attested by the secretary of the board. All
21 moneys in the Professional Foresters Fund are hereby
22 specifically appropriated for the use of the board. The
23 secretary of the board, its office manager, or other
24 designated officer of the board who handles funds shall give
25 surety bond to the state in such sum as the board may

1 determine. The premium on the bond shall be regarded as a
2 proper and necessary expense of the board and shall be paid
3 from the Professional Foresters Fund.
4 "(b) The board may employ such clerical and other
5 assistants as are necessary for the proper performance of its
6 work, or, in lieu of employing clerical assistants, the board
7 may contract with any state department or agency to furnish
8 the board with such clerical assistance as the board deems
9 necessary. The compensation of such assistants or the cost of
10 contracting for such clerical assistance shall be paid out of
11 the Professional Foresters Fund in the manner prescribed
12 herein.
13 "(c) The board is authorized to accept all gifts,
14 bequests, and donations from any source whatsoever, and such
15 gifts, bequests, and donations shall be used or expended in
16 accordance with their terms or stipulations, but in the
17 absence of any such terms or stipulations, such gifts,
18 bequests, or donations may be used or expended for such
19 purposes as the board may determine.
20 "(d)(1) Except as otherwise provided herein, the
21 board may make expenditures for any purpose which, in the
22 opinion of the board, is reasonably necessary for the proper
23 performance of its duties under the provisions of this
24 chapter, including the expenses of the board's delegates to
25 any annual conventions of, and membership dues to, the Society

1 of American Foresters; provided, that under no circumstances
2 shall the total amount of warrants issued by the Comptroller
3 in payment of the expenses and compensation provided for by
4 this chapter exceed the amount of the examination and
5 registration fees, license fees, donations, and other moneys
6 collected by the board as herein provided.
7 "(2) The board may incur and engage in marketing and
8 promotional expenditures and activities in furtherance of its
9 purposes as determined by the board, which may include the
10 sale of nominal items for marketing and promotional purposes.
11 Any proceeds derived by the board from the sale of marketing
12 and promotional items shall be deposited into the Professional
13 Foresters Fund to be used by the board."
14 Section 2. This act shall become effective
15 immediately following its passage and approval by the
16 Governor, or its otherwise becoming law.
