4 ENROLLED, An Act,
5 Relating to agricultural liming material; to amend
6 Sections 2-23-2 and 2-23-4 of the Code of Alabama 1975,
7 relating to the labeling of agricultural liming material sold
8 or imported into this state; to define relative neutralizing
9 value and to require agricultured liming material to be
10 labeled with the relative neutralizing value.
11 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
12 Section 1. Sections 2-23-2 and 2-23-4 of the Code of
13 Alabama 1975, are amended to read as follows:
14 "2-23-2.
15 "The following terms, as used in this chapter and
16 rules and regulations promulgated adopted under authority of
17 this chapter, shall have the following meanings, respectively:
18 "(1) AGRICULTURAL LIMING MATERIALS. Those products
19 whose calcium and magnesium compounds are capable of
20 neutralizing soil acidity
21 "(18) (2) BOARD. The Board of Agriculture and
22 Industries of the State of Alabama.
23 "(10) (3) BRAND. The term, designation, trademark,
24 product name or the specific designation under which an

1 individual or type of agricultural liming material as defined
2 in this section is offered for sale.
3 "(15) (4) BULK. Nonpackaged form.
4 "(5) BURNT LIME. A material made from limestone
5 which consists essentially of calcium oxide or a combination
6 of calcium and magnesium oxides.
7 "(3) (6) CALCITIC LIMESTONE. A calcareous rock
8 composed wholly or largely of calcium carbonate.
9 "(12) (7) CALCIUM CARBONATE EQUIVALENT or CCE. The
10 acid neutralizing capacity of an agricultural liming material
11 expressed as weight percentage of calcium carbonate.
12 "(7) (8) CHALK. A soft, friable, loosely
13 consolidated material composed largely of calcium carbonate.
14 "(17) (9) COMMISSIONER. The Commissioner of
15 Agriculture and Industries of the State of Alabama.
16 "(4) (10) DOLOMITIC LIMESTONE. A calcareous rock
17 composed of calcium and magnesium carbonates with a minimum
18 elemental magnesium (Mg) content of six percent.
19 "(11) FINENESS. The percentage by weight of the
20 material which will pass U.S. standard sieves of specified
21 sizes.
22 "(8) (12) GROUND SHELLS. A product obtained by the
23 grinding of shells of mollusks and which shall carry the name
24 of mollusk origin.

1 "(6) (13) HYDRATED LIME. A material made from burnt
2 lime which consists essentially of calcium hydroxide or a
3 combination of calcium hydroxide with magnesium oxide and/or
4 magnesium hydroxide.
5 "(9) (14) INDUSTRIAL BY-PRODUCT USED AS LIMING
6 MATERIALS. Any industrial by-product containing calcium or
7 calcium and magnesium in forms that will neutralize acidity.
8 "(16) (15) LABEL. Any written or printed matter on
9 or attached to the package or delivery ticket which
10 accompanies a bulk shipment.
11 "(2) (16) LIMESTONE. A calcareous rock composed
12 primarily of calcium carbonate or a combination of calcium and
13 magnesium carbonates.
14 "(14) (17) PERCENT or PERCENTAGE. By weight.
15 "(19) (18) PERSON. Any individual, partnership,
16 corporation, association or other legal entity, or
17 organization.
18 "(19) RELATIVE NEUTRALIZING VALUE or RNV. A
19 calculation that uses calcium carbonate equivalent and
20 fineness to represent the effectiveness of agricultural liming
21 materials.
22 "(13) (20) TON. Two thousand pounds avoirdupois.
23 "2-23-4.
24 "(a) Agricultural liming materials sold or offered
25 for sale in this state for use herein or sold for importation

1 into this state for use herein shall have affixed to each
2 container in a conspicuous manner on the outside thereof a
3 clearly legible printed or stamped label, tag, or statement
4 or, in the case of bulk sales, a delivery slip, setting forth
5 at least all of the following information:
6 "(1) The name and principal office of the
7 manufacturer, processor or distributor;.
8 "(2) The brand name of the material;.
9 "(3) The identification of the product as to the
10 type of agricultural liming material, as defined in
11 subdivisions (2) through (9) of Section 2-23-2;.
12 "(4) The minimum percent guaranteed by weight
13 passing through U. S. standard sieves as prescribed by
14 regulations of the board;.
15 "(5) The minimum guaranteed calcium carbonate
16 equivalent;.
17 "(6) The minimum guaranteed content of elemental
18 magnesium (Mg) if claimed;.
19 "(7) The minimum guaranteed content of available
20 potassium (K2O) and/or or phosphorus (P2O5), or both, if
21 claimed;.
22 "(8) The maximum water content; and.
23 "(9) Net weight.
24 "(10) The relative neutralizing value (RNV) as
25 determined by the following formula:

1 "RNV=CCE x [(0.5 x A) + (1 x B)], where A is the
2 percent of lime passing through a 10-mesh screen, but not a
3 60-mesh screen, and B is the percent of lime passing through a
4 60-mesh screen.
5 "(b) No information or statement shall appear on any
6 package label, delivery slip, or advertising matter which is
7 false or misleading to the purchaser as to the quality,
8 analysis, type, or composition of any agricultural liming
9 material."
10 Section 2. This act shall become effective on the
11 first day of the third month following its passage and
12 approval by the Governor, or its otherwise becoming law.
