4 ENROLLED, An Act,
5 Relating to nurses; to authorize the Alabama Board
6 of Nursing to allow licensed nurses to delegate certain
7 nursing care tasks to non-nurses and to prohibit an agency
8 other than the Alabama Board of Nursing from requiring
9 licensed nurses to obtain additional certification or training
10 in order to delegate nursing care tasks.
11 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
12 Section 1. (a) The Alabama Board of Nursing, by
13 rule, may do the following:
14 (1) Determine what nursing care tasks may or may not
15 be delegated by licensed nurses who provide nursing care in a
16 residential community health setting to unlicensed health care
17 workers, provided specific tasks that require the exercise of
18 independent nursing judgment or intervention may not be
19 delegated.
20 (2) Establish standards of practice by a licensed
21 nurse who delegates nursing care tasks pursuant to subdivision
22 (1).
23 (b) No department, board, or other agency, other
24 than the Alabama Board of Nursing, may require licensed nurses
25 who provide nursing care in a residential community health

2 order to delegate nursing care tasks to unlicensed health care
3 workers.
4 Section 2. This act shall become effective on the
5 first day of the third month following its passage and
6 approval by the Governor, or its otherwise becoming law.
